Does this mean if a solicitor is involved there costs are higher?

thats right. solicitors charge an hourly rate that the losing party has to pay (the bank) so a claim for £10k can be upwards of £20k in legal costs on top!!

But if the bank win, the claimant would then be liable for these costs.

Is this true, do the claims company take cases forward that are likely to loose.

How does anyone know if you have a case. Is it necessary to go to court with every case??????
  • Your not liable for solicitors cost, the solicitors have to get insured before they run your case in court.
    Im GRRRREAT!!

again I think most solicitors or claims firms insure against this but you need to check before they start court proceedings.

Solicitors "should" get insured, they do not "have" to, beyond standard liability for negligence etc. You should check this and see the documentation before instructing to proceed.
  • Ask them about the process before you commit to anything, you need to be comfortable that they know what they’re doing. I would ask:

    1) How do they verify if you have a claim?
    2) What is included in the fee
    3) Will you get a refund if you don’t have a case or is there an admin fee?
    4) When do you have to pay your success fee?

Right guys, Tony, I have been chatting to Delete and have some more info.

They said that they send me out some forms to fill in and when I get them back to them they will do an inhouse request to see if my lender has a copy of the agreement i signed up to.
They then send that agreement to an auditor who will look at it and check to see if there are any problems.
They said that they do the full process through to completion not using solicitors unless absolutely neccessary
If I dont have a claim they said that I will get a full refund
I have to pay the success only when they tell me to stop paying the lender
They said that they have processed over 1000 cases like mine and several thousand in other claim areas.

What do you all think ????

Will they confirm in writing, how many of these were successful? Processing a claim means nothing.
