unsigned contract

Hallo everyone I took out a new 24 month contract .when I got to the airport as I was flying away on holiday for 3 months ,I received a voice mail and the Vodafone adviser who had sold me the contract left a message that there was a problem with my new contract and I had to come back but it was too late as I was on my way. Now when I looked at the contract form I had signed I realised that I had signed my part of the contract but the poor chap had not signed his part which is the Vodafone part of the contract. Now bearing in mind the fuss that is always generated with the signing of these contracts and the legal issues involved my question is that is this contract therefore legal ? Considering the way these phone companies are always trying to stuff us.

    So yor basicaly asking "Can I keep this phone without paying a penny for it?"

    Phone companys are out to make money the same as any other business.
    The more losses they make with people like you trying it on the more they need to recover losses elsewhere e.g call charges etc

    I imagine the contract wont be activated unless you phone up wanting it to be activated and explain your situation.

    Mate I have had lots of contracts ok I don't care about the money they make its their money not yours or mine ok my question is that is this contract legalY binding considering they didn't sign their part.

    No I don't have to activate it cause am not using the sim yet as am away and the phone was not sim locked so using another sim till I come back.

    Its legally binding.

    Not least for the fact the sim has probably been activated within 48 hours of leaving store.
    Also using the phone with another sim etc makes it more permanent.

    Inicidently if you purchased through 'duty free area' of the airport, on your return you would not be able to get in there to go to the store (unless you are going on another trip).

    well I do because the more money they make they can afford to have better deals for the rest of us.

    to answer your question though is that the phone you took was on the condition you also took the airtime agreement so they would be within their rights to block the phones IMEI number

    If the OP is asking "Can I get away scot-free with not paying?", the answer comes in two parts:

    1) Maybe, if you fought it long and hard in court
    BUT...
    2) Remember the poor chap that sold you the phone will most likely get the sack for it.

    yeh actually you are right about the poor chap, and thats why, as soon as am back all go to the branch and let him sighn it cause he gave me a good deal and i dont want him to looze his job cause am quiet happy with my new htc desire case closed.
