boots photo printing disaster!!

my brother in law came from abroad to visit us for a couple of weeks (in birmingham)...he went to London for a weekend trip and to meet some friends..he visited as many touristic places as possible and used one of those disposable cameras..he gave the film to boots for photo printing and to get a CD of the photos..on collection today, he discovered that they handed him photos of another customer..on asking them, they could not find his photos...he is distraught..he is young student and the trip to london cost him a fortune plus some of the friends he met have left as they were already visiting their families...boots told him to wait for few days in case another customer return the photos!!!!where do you think he stands legally?

    Well, a refund of the processing costs and the price of the film would be expected. Unfortunately, it's impossible to quantify the 'sentimental' value of the photos, so there's not likely to be a set value of compensation. I'd expect some money or vouchers from Boots as an apology and gesture of good will, but legally there's not much ground to demand this or anything more.

    Only other option I could think of is some kind of action under Data Protection laws, they're obviously not taking enough care with customers personal photos.

    Possible claim for additional damages depending on the circumstances and, in particular, whether an effective limitation of liability provision applies (e.g. a notice, signed order form, etc).

    Difficult to prove.

    thank you all.. i dont think they can argue about refunding the processing cost but this guy paid a lot of money, at least for him, to visit, and take pictures, at Madamme Taussauds, london eye..etc and now it is all lost thanks to an idiot at boots who did not do his/her job properly...surely he should be compensated

    Do what Boots says and wait a few days to see if the other customer, who likely was given the wrong photos, returns to get the correct ones. It's a bit early to be thinking of compensation yet don't you think.

    i would assume you r b-in-law would have the order number of HIS prints/ CD. Is it worth a call to Boots head office to see if they have it saved as a backup file on the main computer? Not sure if they do but worth a try??

    Apart from that I don't recall Boots compensating more then the film and processing charges - I once knew a store to loose a customers entire order - of wedding film!! How could you compensate that??

    i was given the wrong negatives once by boots years ago (when i couldnt afford a digicam)... correct pictures though... noticed MONTHS later because its not something I'd usually check and i caught a glimps of 2 people I didn't know in the negatives... I didn't do anything about it - seemed a bit late in the day

    I'd imagine if the other customer has been given a whole set of wrong photos they'd contact boots though?! unless they are weird... they might like his pictures? hehe

    and why not? if you pay some one to do work on your car,house..etc and he makes a complete mess of it you will expect him to pay for putting things right.
