Need help - married or not?

    If you are asking if you are legally married in Britain then yes you are you wouldnt be able to move back to Britain and marry someone else you would still need to get divorced first.

    If thats not what you are asking sorry for my presumption but im not sure what you mean by repercussions ?

    You might be able to get married in the UK and get away with it, but you would be still breaking the law. It's not worth the risk I think. Maybe visit the US consulate and ask for advice.

    Sorry to have to tell you this, but you will need to get divorced before you can remarry.

    I married abroad, and basically my solicitor told me that if the marriage was legal in the country where the ceremony was performed, then it is legally recognised here.

    And of course it will be legally binding in the States too.

    You're entitled to 30 minutes of free legal advice from a solicitor. Choose one who specialises in matrimonial law and divorce and they will be able to give you advice on where to go from here.

    Is your spouse American or still living in America? Or did they come back to England with you? What name is your passport in?

    If you're going on holiday and everything is in your maiden name I'd leave it as that. But if your passport is in the married name, fess up on the immigration forms otherwise you could open a can of worms.

    I think Britney laughed at the time, but woke up the next morning in total shock and horror. You're married ! If an American, or any other nationalaity, official or official document asks your status - you're married.
    If you've been married for two years and separtated since you got married you can divorce in the UK if you are both in agreement.

    It is just the same as getting divorced if you had married here. You have to supply the courts with your marriage certificate. Do you know where your "spouse" is now?

    On what grounds will you file for divorce?

    Ask the US Embassy how you can obtain a copy of your marriage certificate, or the CAB. I'm presuming you can remember where and when you married, and have a read of this http://www.lawontheweb.co.uk/basics/family.htm

    ETA -I'm now wondering why I'm feeling more stupid than the OP :)

    You can get a copy of your marriage certificate from the office you got it from in the first place. Just send however much it costs to get one, (in $ of course).
    As everyone else has said, yes you are legally married. I married in USA and its recognised in UK so.. sorry to tell you that :rotfl:
