    QUOTE]

This shows how someones reply can be read differently by different people. To me the OP was clearly saying if her daughter was compensated with a toy and was happy with it, then so would the OP be happy.

Obviously the OP had to take the toy back, unless you were expecting her daughter to, and therefore if her daughter was happy it would cover her time as well.

Or were you deliberately trying to bait her?

Did your daughter suffer any financial loss as a result of being cut by the jeans?

In law, it is called "general damages". Means that damages are awarded for pain and suffering. And rightly so.

Last time I was in Matalan a metal clothes bar packed full of clothes fell on me and my 5 week old baby (in the pram). The sales assistants rushed over and 'told me off' for making such a mess. Complained to Matalan HO and they couldn't have cared less TBH, only after stating I was going to inform the Health & Safety Exec did they take notice. They sent me £20 of vouchers which were given to my mum as I refuse to set foot back in the store!

This item clearly failed their quality inspection. How many more may be out there?
I agree with Mum notifying the head office, she has been sensible, in wanting to prevent this happening to others.

  • Just thought id post back and let you guys know how it turned out. Matalan have assured me that this was one item that failed their quality control test and they have had no other complaints. They have said they will refund me for the jeans and also send my daughter a £30 gift card with a letter of appology so im pleased to say it all sorted.
For those who offered words of help i thank you.
For those who could only post stupid comments...............well im sure you can guess :rotfl:

Chances are that by now your daughter has forgotten about her scratch. Had you thought it suitable, you could have bought her a small toy as a treat at the time of the accident. Instead you are going to wait until the retailer gets back to you, which could take a few weeks, and then present a toy to your child to remind them that they were upset a few weeks ago.

I think you need to reassess your motivations in reporting this issue.

now now her leg was cut open get yer facts right dmg hehehe :rotfl::rotfl:

My ex-wife gave me 20 years of pain and suffering, yet I ended up compensating her. It's just not fair
