Talk Talk Slamming Tiscali customers without warning

Looks like the OP was connected to Tiscali LLU and has simply been ported to TalkTalk LLU and as this is effectively within the same group I'd guess that it's really up to Tiscali (as part of TalkTalk) which physical equipment the OP is connected to, just as customers would have no say when their service provider upgrades the MSANs and other infrastructure providing the service ......

I have just experienced the same as you with tiscali/talk talk.
I totally understand your point, I have contacted all the providers and so far they all charge to take an llu line over. I have contacted plusnet and am still awaiting a reply to see if there will be a migration cost but fingers cross.
We joined tiscali before talk talk buy out, worth contacting Ofcom as they are monitoring the situation. Complaints about this are going through the roof since February according to the Ofcom rep I spoke too.
unfortunately some people on this forum don't seem to understand how angry we are that we have to pay to switch provider and just tell us to shut up moaning.
Good Luck and keep us up to date. Ill let you know about plusnet when i get a response.0 -

The line wasn't on Tiscali's LLU as they didn't have one on my exchange. It was and always has been a BT line.
So the situation was that you were paying Tiscali for line rental and as they had no equipment in the exchange at the time they hooked you up to BT equipment until Tiscali LLU equipment became available. If Tiscali LLU was never availabe in your exchange (search for 'ask sam' and go to the site to check) they would have been paying BT for the privilege of using their equipment until LLUd. With the tie up with TalkTalk, LLU equipment which belongs to the group has become available, therefore you've simply been moved across to the TT MSANs.
If you were paying line rental directly to BT and Tiscali/TalkTalk had taken over the line that would be considered as slamming as the action would have been conducted for financial gain of one corporate over another, but in the case of a wholly owned subsidiary I cannot see that it could be as you'll still be paying the line rental to Tiscali and they, in turn, continue to rent your line from BT. I would guess that the only reasonable complaint which you could possibly have would be if the quality of service had been degraded as a direct result of the action, so you would have to provide service statistics from both before & after the change to support a position (Sync rate, SNR etc).
Have you experienced a degraded service since the change ??

Yes thats what I should have typed if I could remember the site at the time .... brain & memory don't always engage in the appropriate order .......... but google still shows the correct site as the first unsponsored result ....
Agree the sky situation seems to be different with the customer not contracting to a provider involved in a corporate merger ...

Once you moved your line rental to Tiscali and paid them direct to Tiscali you were no longer a BT Customer, so you could not have been slammed.
You can return to BT free of charge under the return to donor scheme but will be subject to a 12 month contract.0 -

The issue here is about choice. Talk Talk were obliged to notify before they connected to am LLU in accordance with the contract and failed to do so. Had they done this I would have had the choice to stay and put up with them or could have moved before they did it.0 -

BT broadband rolling contracts refered to Ofcom by TalkTalk

TalkTalk is calling on Ofcom to ban BT, and any other provider, from using ‘rolling contracts’ to hook customers in to long-term contracts.
BT came under heavy criticism yesterday in a Which? report for using contracts which tie consumers in to the service for 18 months and are then renewed at the end of the 18 months. This potentially leaves broadband customers tied-in endlessly unless they specifically request for a contract not to be renewed.
Those wishing to leave an 18 month contract, before it is over, can find they face penalties and TalkTalk believes this is unfair and stifling the market among those considering changing broadband provider. It is calling on the industry regulator, Ofcom, to take action.
The ISP claims that BT is relying on customers not being aware or not getting around to cancelling a rolling contract when they have the opportunity.
“It’s unacceptable that BT can place the onus on its customers to cancel their contracts – simply because it knows that many of them will forget,” a spokesman told SamKnows.
“We would like to see these unfair rolling contracts stamped out and have already called upon Ofcom to take a firm line in this area.”0 -

Exactly. No slamming has taken place, you chose to go with Tiscali for a cheaper deal.
Perhaps if you had done a bit more research before signing up the the most consistently complained about provider in the land for years, you would not be moaning now!
You do not have a case as it was you who decided to pay your line rental directly to Tiscali to save some pennies!
Paying your line rental directly to Tiscali, allows them to supply their service however they choose.The issue here is about choice.
