Vodafone lumped me with a crappy phone

The alarm clock issue is a very well documented "issue" with Android phones. And the Tattoo is actually a very good phone.
If the OP goes onto the Vodafone forum, there's lots of information about it on there.
There are many other Alarm clock apps available on the Android Market - both FOC and paid. One of these may suit you better than using the 'stock' version.
Could you maybe have set the alarm and then put your phone to silent or vibrate etc. to avoid being woken by a phone call etc.
Essentially - this is nothing to do with Vodafone. It's simply the way that the Android firmware operates.
Also - as previously mentioned above - are you using a task killer - as this can have a major effect if the exceptions are not applied correctly.0 -
Do you work for Vodafone? Sounds like you are towing the company line.
Just because Vodafone made up some crappy rule that you can only return a phone within 7 days, back when phones were just a keypad and few other simple functions does not mean it's law. Nor that it's necessary still "fair" now, considering how complicated the phones they are selling are nowadays. I bet it's just the bare minimum they can get away with by law, which I now think is unfair based on how complicated the phones are.
To recap - if you read my first message properly, you will see I got a Android phone, which as I said is as complex as a computer.
Maybe if I was on the dole, I could download the 100 page user guide and go through all the features within the first 7 days of having it. But as someone with a full-time job, I don't have hours to kill playing with a new phone.
I took for granted, given the fact they advertised the phone had all these various features, that all the various features the phone claimed to have ACTUALLY WORKED.
And I think it's reasonable to expect it to work as well as the previous phone they sold me. After all, it's called an upgrade, not a downgrade (although, frankly, that's what it is).
And as both the problems I mentioned happened well and truly AFTER the initial 7 days, there was no for me to know within 7 days.
You are confusing two issues.
Firstly the hand set or software may be faulty - in which case you need to write a recorded delivery letter to Vodaphone and formally reject the handset as not fit for purpose under the Sale of Goods Act, If you are in the first three months the burden of proof is NOT on the customer and you can request a full refund. The situation is more complex if the handset was a free gift (upgrade): you will then be entitled to a repair or replacement of the same model.
A completely separate issue is your rights under the Distance Selling Regulations which give you seven days to rescind the contract. Unfortunately you have missed the boat; working full time is a pathetic excuse - that is forty to fifty hours out of a 168 hour week (167 this week due to the clocks going forwards!).Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0 -

Actually I think it's six months not three.
And as I've said elsewhere cancelling the phone DOES NOT automatically mean you have cancelled the airtime agreement, they are legally seperate contracts. It's a big grey area and untested in Law about distance selling rules and upgrades, DSR covers new contracts an upgrade is not an new contract, it's a continuation of an existing business relationship.
Cancelling and rejecting / returning the phone means you are entitled to the cost of the phone back, which may well be nothing if it was an upgrade. It does NOT automatically entitle you to cancel the airtime contract, you may have to continue that without a replacment phone if Vodafone choose to not offer you a replacement.0 -
Acting like a total !!! wont get you anywhere. Go learn your facts because your just making a total fool of yourself.0

wattc,
No I don't work for Vodafone, and I am most certainly not towing the party line with them, in fact I had a Blackberry Storm purchased about 18 months ago, and if you look back in my threads, you may see how p***ed off I was with them at the time, I looked into rejecting the phone, and I could have but I wouldn't have got anything from Vodafone, all I could do was keep arguing with CS until they gave me a replacement which I did get with several bonus's added to my account for the amount of wasted trips to the shop for the return of the phone, and each time I had no phone either. It looks as if what other posters are saying there could be problems with app's, surely thats something to do with the app's supplier.
I would also like to add that I don't particularly like the tone in which you suggest I have plenty of free time on my hands to look at manuals and visit the shop to do what I did, I happen to be a single father of two and hold down a full time job at the same time, I work from 7am till 3.30pm and travel an hour in each direction to my work, I also happen to be off for a weeks holiday and just happened to have a spare couple of hours whilst my youngest was in nursery to pop to the Voda shop to have a browse and conversation with the shop manager before renewing my contract.
If you phone up CS or email one of the Voda reps using one of the codes in the threads around yours, they will do what they can to help, but just to ask, would you want to help someone who was automatically demanding this, that and the next thing, go in with an open mind and do some searching on the net to see if anyone else has had similar problems and if they have been rectified, and as suggested earlier, see the HTC website to see if there are software/firmware upgrades to be downloaded.
Lastly, I just received my new phone today by courier, and after using it properly for the past few hours it may not be the phone for me after all, so much for doing my research!! lolThanks to all the competition posters.0 -
Seems like you did not do your research and now just expect to be able to change your phone. Smitchy gave you good advice which you should take heed of. If you dont like the bugs or if they cannot be fixed simply then sell the phone on ebay as they are quite popular I think! :-)0

Personally, I don't understand why you are all defending the corporation Vodafone. This is supposed to be a CONSUMER website. I don't understand how you interpret "Consumer Revenge" as "pat the corporation who take your money and offer you poor service in exchange on the head".
I'm pointing out the fact that the 7 day returns policy is not fair with complex, multi-feature modern phones. And if people are saying you don't even get that if you get your phone in a shop, then I think that really shows mobile phone companies attitude to customers. "You bought it and you can't get your money back now - naw naw naw naw naw".
If someone sells you a phone that doesn't work reliably, there is no reason, to me, why they shouldn't replace it with another. I don't particularly care if Vodafone say "We can't, it's the rules". Of course they are going to say that, as they make up their own rules. But who are they to set the rules?
Just because the banks made rules that say you have to pay £30 every time you go overdrawn didn't mean it was fair and couldn't be challenged.
I think at least 28 days would be fairer with these new phones.
And for those interested, my phone is updated with the latest firmware that Vodafone have released. So these bugs are BUILT-IN. This is what I have been sold.
Anyway, regards to you all.0 -
Who are they to set the rules? It's their company, they can have whatever rules they like.0

Yes it is a consumer site but that does not mean everyone has to agree with you.
Phone company's have these rules for a reason when you return a phone it reduces the value as they can no longer sell it as new
obviously no company is out to make losses so they put these rules in place and in fairness 7 working days is more than enough time to try out a phone full time job or not0 -

That is just not true. Way too late to reject the goods and the six months burden of proof does not entitle you to a full refund.0
