please help ive got into a tricky situtaion

if anyone lectures me ill probably not come on here again- because im not looking for lectures and nasty statements- so if anyone has the urge to do this- please refrain

i did a debt relief order yesterday, in this order i added a provident loan of £875 but this i only took out last week,

i didnt borrow £875 I borrowed 430- and im not going to go into the reasons why i did it but i did- if i wanted to be fraudulent- i would have spent the lats year wracking up loads of debts and then got it wiped off on the DRO it just happens that i have done this loan too near to the debt relief order. but to be hyonest if id had relaise that i would ahve to pay £875 back on a loan of £430 i woul;dnt have done it, and had i known provident could contest the DRO i wouldnt have dne it either. i knew it was sailihng close to the wind but i also knew provident should look into someones credit history- and if they did they would hacve seen that i had £8,000 worth of debt and several county court judgements.

i have jst told the provident lady- who rolls up in her big car off the backs of poor thick people, and she goton her high horse and told me whatb i ahve done is illegal- and asked why i had done it when i knew i was going to do the order- i could have replied with a similar question- why do you so this job when you know you are taking a huge amount of money from poeple that cant get credit elsewhere? why do you do that> but that issue is obviously neatly tucked away in her subconsious somewhere and absolves her of any involvement over the loan sharking.

i must admit i was horified when i saw the £875- the debt would have been £500 but i was made to pay the previous interest of the previous 100- they took a lot of interest out of that one and its been added to the next one- somehow adding up to £875- and i wasnt even behind in any payments, that is simply shocknig- for borrowing the £430 i woujld havwe to pay £400.

is there not a loop hole i can get them on? like irresponsible lending? i am not mentally well and amm on medication will that help.

I knew i was sailing close to the wind but i didnt know i was acting illegally or fraudulently- i honestly didnt see it like that- i thought provident could get a taste of their own medecine- why do they always win? they shouldnt be in business at all because they are leeches for vulnerable people. i know that sounds like an excuse but before i asked provident i tried every single avenue- exhausted it so i could get some carpeting down- and i even tried asking my suport worker for charity money- i applied for crisis loan and this was denied and had to appeal that four times until there was no appeals leftm tried credit union- who wouldnt lend- depsite me showiong i had enough to pay back. so i kind of got a bit desperate and thought i could use the cask to get myself out of the poverty rut with- if i could buy things so i could start my own business.

its all a bit of a mess isnt it. any ideas?

    im legally not allowed to pay any creditors back after its gone through the debt relief

    First - calm! I know (as you do) that getting a loan so close to DRO date wasn't the wisest of choices, but you've done it and there is no going back. What's done is done. But it's probably not best stating they should get a taste of their own medicine. You're not judge and jury, no matter what we all think of these companies.

    I would strongly recommend NOT talking to this provident woman again. Let her go swing. There is nothing she can do to you so do not even entertain her anymore. She'll only moan and perhaps lie a lot, don't got there.

    Just let the DRO run it's course and only discuss with your OR any details about it. If it becomes a problem then deal with it then.
  • The provy rep most likely knows sod all about law and legalities.

    Trust me, i know someone who was one, and there is no way she would have a clue;)

    But the OR does, and as you already know, that is where the problem may lie.

    And i have seen many provi loan agreemants where the true cost of the loan was not stated to the debtor, strangly the debtors copy was blank where it should have been stated, so there may be a way to contest the agreemant there, but doubt the OR will care.

    I would not pay any attention to what she said, she is just bothered about her commision.

    I would wait and see what the OR does, that is all that matters, though if they do contest the DRO, the OR has no choice but to look into it

    The only advice I have is to be upfront and tell the truth to those concerned ~ but a part of me has a niggling feeling that you knew what you were doing all along, otherwise you wouldn't feel that you had to justify it so much in your post.

    Now, the problem there is that is a judgmental post, no matter how probable you feel you are correct, nor how many others may be inclined to agree with you, as the sticky says, from the boss himself, you should have refrained from posting ;)

    yes of course i knew what iwn as doing, i didnt hide that did I? what i didnt know was the ramifications of my actions- i thought the order would be cast iron.

    Hi Hun,

    Desperation makes us all do daft things....this board is about support & not lectures. You are where you are with this Provident loan so I would explain that to the DRO administrator & be totally upfront & honest about it. They will appreciate that .

    Don`t beat yourself up about it...just resolve to get it sorted.

    Above everything else do not accept any harrassing behavior from the Provident. They are not allowed to do that.

    I'm not entirely sure whether you took out the loan because you needed it, or because you wanted to teach Provident a lesson?

    I completely agree that Provident - with their extortionate rates of interest, hard sell and hard ball attitudes - need to be taught a lesson. (Watch that extremely judgemental statment pass the 'this board is not for judgement' filters, unchallenged :D).

    However, I can't see that losing out on a £500 loan, plus the extortionate rates of interest, will make them see the error of their ways. It would be nice if I was wrong on that one, but I can't be that optimistic, I'm afraid.

    As for not realising the consequences of taking out a loan so close to applying for a DRO, and at a time when you knew you intended to apply for a DRO...

    I'm afraid that I do feel outraged on behalf of all the people who took the time to make you aware of those consequences:
