6. The Price and Payment
6.1 The price to be paid by the Customer shall be the sum(s) shown by the Company's Invoice(s) which shall be based on the sum quoted or the Company's list price for the goods but which may also take into account any increase in the cost of goods and materials, increased labour, transport, storage, fuel and power charges arising after the date of the quotation or contract or during the performance of the contract.
be careful guys!0 -
Yes but if that is the case then they would need to inform us.
another reason might be it's out of stock/discontinued and i've seen a few websites that put this item to £0.00 but it looks like they have forgotten to add the out of stock bit.0 -
So basically they would have to inform us and allow the opportunity to cancel the order at no charge, and refund any delivery charge incurred right? After all as a consumer with rights I have made no error - the error, if any, is theirs and so should not penalise the consumer/customer. The clause in the terms and conditions is probably not worth much - hence the use of the word 'may' in 'but which may also take into account any increase in the cost of goods '. If that was a concrete statement then the word 'may' would definatelly not be there.????0

I tried to order one but it says product not found.......0

And anyway, once they've 'confirmed' the order, they have entered fully into an agreement right? A binding contract?0

10:18am. Looks like they've spotted their mistake. No longer on the site - suggesting they realise they've cocked up.0

Contract is not formed until payment is taken for goods - not sure where we stand with somehting like this where there is only a delivery charge?
Could they worm out of it even if they have charged bu saying they have charged for delivery not for goods???0 -
my tip..... everybody just relax and see what they do about there mistake!!!
keep cool and dont get hot under the collar !!!:j looking after the housekeeper sir !!0 -
But what if payment was taken? It says on all confirmations that payment is £0.00 with a £0.00 VAT element. This has been accounted for in confirmations, plus the P&P element. As the product is no longer shown on the site, then the price cannot have gone up and so remains at £0.00 as the last price shown. Therefore no indication of any price rise has been given, neither an indication of no stock levels. I for one think that they have to come up with the goods. If there's a problem who would be able to help? Citizens Advice Beaurough or Trading Standards?0
