I think that's rather subjective to be honest. The phrase could be taken in a variety of ways and it's rather disingenuous of the seller to advertise the phones under the heading 'as new' if he failed to select the correct option in the drop down box when listing a mobile phone.Moglex wrote:As new has a very definite meaning.

Provided it satisfies that criterion you have done nothing wrong.
It doesn't matter whether it is something that was returned unused because the original buyer didn't like the colour when they opened the box, or it has had parts replaced to make it work and or cosmetically mint.
It sounds as if your buyer simply does not understand what 'as new' means.0 -
They were factory reconditioned by the phone manufacturer. I personally only opened one box the battery was brand new and sealed the battery cover was sealed in a bag as was the charger and the screen had protective film over it. There were no marks or scratches and the manual looked new. They were indistinguishable from brand new ones. It was printed reconditioned on the side of the box so it couldn’t be removed.
In the ad I just left the drop down menu heading new/used blank.
Personally if I saw something advertised ‘as new’ I wouldn’t be expecting a brand new item but I would expect the item to be pretty much the same as a brand new one.
Guess its all subjective and different people interpret things in different ways.0 -
I am looking for a mobile phone as a present - if I bought one "as new" I would not expect "reconditioned" to be printed on the side of the box thus spoiling my chance of giving a present that not only looks as new..but they would think IS new. I would not be happy.I have had brain surgery - sorry if I am a little confused sometimes

Well sorry but seems like the neg was deserved in this case as it seems you knowingly tried to to pass off reconditioned phones as brand new. whilst I am happy to buy reconditioned items, if I bid on an auction described "as new", i would be willing to pay a higher premium on that item compared to a reconditioned item
your buyer could have bought this item intending on giving it as a gift, but would look a meanie if it has reconditioned stamped on the box
as described above, sometimes its just a faulty battery replaced, but in others, it could have been a more serious fault

I once purchased a nightlight for my babe, when i opened the sealed box i found another childs medical card in it !!
this was bought from a big toy store, turned out it didnt work either and when i pointed out they were knowingly selling second hand faulty goods the manager was really rude- i left in the end so wound up and all i managed to get was another one, which broke anyway 2 weeks later.
just goes to show that you have no guarantees even off of ebay, in my opinion with ebay you spend your money and take a chance. bit like gambling. it comes off right your chuffed if not shrug your shoulders and think oh well maybe next time !!

Personally the words "as new" would tell be that the item was in the same condition that it would be if it was new not reconditioned. part of the item you sold was all the pacakging and you have said that the box was marked reconditioned which isnt how a new phone would be marked so as far as Im concerned it wasnt "as new"
If I bought an as new item I would expect a new phone with all the bits and box the seal may have been broken on the box and unpacked and all returned to the box and packing nothing different.
You were very deceptive in your choice of words the box clearly stated reconditioned so why didnt you descibe them as that? becasue reconditioned phones dont sell for as much. I would have requested a refund including all costs and left negative FB.0
