I have pretty much same circumstances as this a little email tennis all to same effect wrong price not our fault get lost type of thing despite payment being taken from card, also got the yes we sent it to legal dept and they told us to tell you to take a running jump off a cliff response too, phoned c/s who stated order is still to be despatched and to ignore emails yet refund on my card account now, but letter in post to apologise for delay new stock due in order to arrive shortly so haven't a clue where I am with them at the moment!
Back on the phone Monday I suppose.Four guns yet only one trigger prepare for a volley.Together we can make a difference.0 -

25 Jan: Ordered 4 pairs of these jeans @ 11p each.
28 Jan: Letter from Corinne Stevens (Customer Service Manager) saying that they have sold out and cannot get any more, so have cancelled order.
31 Jan: Letter from Corinne Stevens saying new stock expected any day and my delivery will be within 3 weeks
01 Feb email from Joan Beeby (Interenet Customer Services) saying it was a pricing erorr, order has been cancelled and CC refunded.
01 Feb: I replied to Joans email stating contract had been made when funds were taken from CC etc
02 Feb: email from Neil Burnett (Interenet Customer Services) saying to conatct Additions Direct Royal Avenue Widnes WA88 1SS with any complaint.
For once, I might actually write that letter.
What a waste of space this crowd is!0 -

Does anyone have the email address? I ordered some and got an email back saying they were mis priced and would be refunding me unless i wanted to re order. I've yet to receive the refund and i deleted the email from them.0

Further to my post (4 up from here), out of the blue, a package turn up this morning. The enclosed papaer work clearly shows the jeans at a cost of £0.11 .

I haven't been following this thread, but I seen much of my own experience, I actually had forgotten about it until I received a 'sorry you have been refused credit' from Daxon well checking that's the free parka and I didn't ask for credit - another story, anyway on checking my bank account I saw that this company had debited me, ironically on the day after a letter they sent was dated! anyway didn't know of this when I phoned them after looking on their web site at the order from the number on the confirmation email they had sent. checked the T&C's saw it said about acceptance being on dispatch of orders, well that's BS, once the consideration is accepted (the money) they've accepted the order. The women on the phone couldn't make head nor tail of the information she had either and put me through to someone who also had difficulty but she said one package is on the way but that the other sizes are out of stock which is why they were cancelled but then gave 21 and 45 days lead time on them I said fine, like me she didn't understand why there was a difference but as I said at that price I am willing to wait. so I guess it's wait and see.vBulletin getting better!0

as you can see this doesn't apply, what does apply is straight forward contract law as I mentioned above, once they accept the consideration they supersede any of their t&c's to the contraryvBulletin getting better!0 -

Loss of bargain is something that can be claimed if the errant supplier is stating that the goods are out of stock or otherwise unable to be supplied - having taken payment they're duty bound to supply. So, then the injured party is entitled to purchase the (identical) goods elsewhere and claim this "loss of bargain" - which is what I intended to inform them I would do unless they supply within the 30 days allowed under DSR. I think this fits with your account - the determinable amount being easily calculated.
As they're actually now stating that they're unable (ie unwilling!!) to supply due to pricing error, how would you suggest proceeding?0
