    No - but I don't think you seem to give 2 hoots either. Your previous posts are more concerned with preserving your NCD and getting on with your car upgrade, while at the same time asking a family to sign away all their legal rights (without success I might add).
    Its a right pain tbh and causing unneccasary stress surely with this letter from the parents they cannot pursue it any further...no part wants any investigation and all of us want to get on with life
    The problem is at present that i need to re-new my insurance with a different company and to do so and keep my NCB
    If i was to recieve a letter from the road traffic collision investigation unit stating that it was not my fault would the open claim be dropped??

    Yes Gaz , it IS traumatic.

    I i speak as a PARENT MYSELF so before anyone jumps in to ask me would i have this opinion if it were MY OWN child , then YES i would !

    My own daughter isnt much younger than the OP and im sure hes having a hard enough time dealing with this accident without people flaming him !!

    Matty selecting parts of text missing out the important bits such as the girl is ok,the girl is happy, the fact im losing sleep over it and having the flashbacks had to consult my dr regarding it all! Admitidly im not a regular on here lately but to be honnest i can see why i left last time!

    I really feel for you.

    The same happened to my Dad a couple of years ago. Kid ran out between parked cars and Dad clipped him. The kid dislocated his shoulder and we never heard anything since.

    My Dad cried for a couple of days as he couldn't get it out of his mind ~ it's awful to watch a grown man weep, especially when you can't do sod all to help. He too had flashbacks for AGES afterwards, and wouldn't drive up the road to come to mine (that's where it happened) for many months afterwards ~ he'd park at the bottom of the road and walk up, and he would never visit when it was school finish time because of all the kids around.

    I blame the parents ~ if children who are out CANNOT cross the roads properly, then they shouldn't be out alone in the first place.

    Never mind the red van man, if his van was taxed/MOT'd etc, he can park where he bloody likes! (within reason of course).

    I hope you get it sorted and I hope the kids parents grow some bloody brains! :mad:

    The kids parents are fantastic,we had a really good chat and the little girl is getting on great so thats really what they are bothered about they said claiming hadnt crossed the mind! Also they said my insurance are just being awkward but this should soon be sorted and the claim removed. I was the same as your father since the accident i only drove up there road twice once yesterday once on the day after,i have walked there ever since.

    Whilst waiting for the ambulance/police the girls mother came out too,both her and the girls dad said that they have been telling the owner of the van for 6months that someone will get hurt soon as its a pain to reverse out and see whats coming when its parked on the road,the man who had possesion of the red van has a massive drive-way too. The father rang this person whilst we we're still waiting he said your f***ing van has caused my daughter to be knocked down quite agresivily

    The girls parents may be feeling very guilty, after all, how can the guy with the red van be to blame? It's the child's fault for running out and the parents fault for allowing that to happen.

    You teach children (or should do!) to cross where it is safe, so if they know there are vans parked there, the children shouldn't be crossing there in the first place, let alone running across the road and obviously not looking.

    When I started to let my kids cross the road, I did it with them for weeks, then I would watch them from the window when they started to do it themselves ~ give them their due, they always crossed where it was safe and always looked both ways, but if I would have ever caught them just running across the road, they wouldn't have been allowed out on their own again till they did it properly and safely.

    The kid my Dad hit still plays out in the road now along with other kids from their street (on their bikes riding in and out of cars/playing with a ball across the whole street etc), so it looks like the kids and their parents didn't learn a thing from the accident!

    gaz - I'm really embarrassed by some of the comments you are getting.
    It does seem to me that the accident was not your fault and you clearly are a caring person.
    You are entitled to be concerned about your own losses, but it's clear you care also.

    My FIL hit a pedestrian who ran into the road whilst training greyhounds.
    The pedestrian did make a claim against my FIL which was turnned down.
    But I know that the legal system is not on the side of a drive with a heavy box against a small girl.
    The van driver may not have been considerat, but her parents are to blame.

    You have every right to be compensated and even suing them for the psycological grief they have caused you.
    However the law is not on your side here.
    I don't know why a few people are being nasty and agressive. I cannot see anything in your posts that would provike such a reaction.
    I'm sorry and embarrassed you are getting that response as this is a great site.

    Well done for doing what's right and not what you were advised by those with liability in mind.
