I am not a lawyer, but so far as I'm aware the legal guardians deciding not to take it further has no effect on whether the girl herself can sue in future.0

No thats not the issue,The problem is at present that i need to re-new my insurance with a different company and to do so and keep my NCB i need the parents to advise my insurers that no claim would be made at present however it will still require investigation0

You might just have to take that one on the chin and stay with your present insurer until it has worked itself out, for I cannot imagine it being a particularly speedy resolution.
That or lose the no claims, which I am guessing is more costly that the difference between your (potential) new insurer and your existing.Thinking critically since 1996....0 -
Basically i was advised if the 3rd party didnt wish this to go any further then that was it!however i have already put the deposit down on my new car and as state the current company will not insure me on the new one due to its power!
Its a right pain tbh and causing unneccasary stress surely with this letter from the parents they cannot pursue it any further...no part wants any investigation and all of us want to get on with life0 -
The 3rd party you injured is the child...not the parents! Your stress comes second I think perhaps. Who do you think should be the one to be stressed? you or the child?0

That isn't your call though.
As others have alluded to, the parents of the child can sue in her name up until her 18th birthday. At that point, she can sue in her own name up until her 21st birthday.
The piece of paper you've obtained is worthless.
If you're not going to listen to the advice given on this board or by your insurers, don't bother posting.0 -

Can't understand how you have the money for a new, more powerful car but can't afford a hit on the insurance. If the combination of car + driver risk = too expensive, there's a message in there for you

Do you actually understand how traumatic it is hitting a child? The child when i went round yesterday was happy as anything an said she was in no pain what so ever....i on the other-hand have flashbacks,trouble sleeping and withdrawn enthusiasm for driving all for a child seemingly un-aware of how to cross a road safely, i understand the way in which the law works however i was asked if the parents had signed that they we're not making a claim they have now done this, the little girl obviously cannot sign herself due to her age!!Most people here are similar to that of the insurers and dont understand that the obvious victim in this could of done more than myself to prevent the accident!!i was the unfortunate one who could not have done anything to prevent the incident no one seems to realise this.0

Your post which i have quoted struck a chord with me.....
Many years agao when my brother was about 20 years old , a child ran out in front of him just as the one in your situation has done.
What you say about it being traumatic is very true....obviously the people on this board DO NOT have the "experience" of what it feels like to know that you have knocked down and injured a child.
My brother is now almost 40 and to this day he still feels the overwhelming guilt even though he was not liable for the accident.
Dont beat yourself up , it was an accident.0 -
