    Thank you for getting back to me, and I'm obviously pretty gutted to hear that.

    I would therefore like to request the CCTV footage of myself from in the store please. As stated, it was around 11:30pm on Friday the 12th March. I walked in with a chap who was wearing a dark suit with dark spiked hair. I was wearing a long green jacket and have a shaven head. We were the only ones in there at the time, apart from the Security Guard who was wearing a luminous jacket. A couple of minutes later a large chap walked in. He was my mates brother.

    I would like this requested as there may be a chance that the Security Guard picked up the money. Obviously I don't want the throw around accusations, so this would clear any possible wrong doing. Add to this 'if' the Security Guard was dishonest enough to steal from a paying customer, then who is to say that he may not do the same to the business.

    I understand that I may request details of personal information which you hold about me, under the Data Protection Act 1998, and if I would like a copy of the information held on me then I am within my rights to request it.

    I am sure, beings you are dealing with this problem, that you are aware of Subject Access Requests within the law, where individuals whose images are recorded have a right to view the images of themselves and, unless they agree otherwise, to be provided with a copy of the images. This must be provided within 40 calendar days of receiving a request.

    As quoted from the Information Commissioner's Office ( http://www.ico.gov.uk ) CCTV code of practice document, in Section 3, 'What this code covers', it clearly states: This code covers the use of CCTV and other systems which capture images of identifiable individuals or information relating to individuals for any of the following purposes: Seeing what an individual is doing, for example monitoring them in a shop or walking down the street.

    As previously stated, I am 100% sure that I had the money as I used some of it to pay for the sub.

    Dear ****, I understand you are very upset at losing £55. We have investigated the incident as much as we can from our side. We cannot accede to your request for legal reasons. However, if you reported the matter to the police, they can gain access to the CCTV if they decided this was a course of action they wished to pursue. Sorry I cannot be more helpful.     So...I am going to forward the transcript to the local Police to see what occurs. I thought, beings the CCTV is in the Subway store, that it would be down to the Company to deal with it. Obviously not.

    (Can I just say, where I have put ****, that isn't a rude word and he's not referring to me in a abusive way!)

  • Why have you waited the best part of a fortnight to report this to the police.

    And what do you expect them to do, the fact remians that in the first place, you were negiligent in the following.

    1 Misplacing the alleged £55 9Alleged, because it is your word only

    2 taking upteen time to notify the police.

    They would not edit people out of the footage. Most cctv footage is recorded in such a way that if you were to edit in anyway it will tinge the background red to say it has been tampered with rendering it useless as evidence in court.

    CCTV that had been adjusted defeats the object of recording things as they took place! ie there is not point removing people as they may play a role in the potential situation

    That £55 is well gone, You waited too long. Cut your loss and move on.
  • One happens to guess that the £55 was lost at the Curry House in the first place
