    It dismays me to see people unaware of their rights. The Data Protection Act applies to anyone who handles personal data on you except in some very specific circumstances. Businesses, schools, clubs, even private individuals in some circumstances - if someone is engaged in "processing personal data" they are subject to the Act. There are strict limits on how and why information can be gathered and stored and broad rights for you to access and control this data. Wherever your data is processed, you have:

    * a right of access to a copy of the information comprised in their personal data;
    * a right to object to processing that is likely to cause or is causing damage or distress;
    * a right to prevent processing for direct marketing;
    * a right to object to decisions being taken by automated means;
    * a right in certain circumstances to have inaccurate personal data rectified, blocked, erased or destroyed; and
    * a right to claim compensation for damages caused by a breach of the Act.

    The Data Protection Act is a fantastic law that provides us all with a huge amount of control over information that is about us. If you're not sure of your rights in respect to data, I highly recommend a browse of the Information Commissioner's Office website - it really is quite revelatory.

    As a security guard he's probably in charge of the security recording equipment as well. If he gets wind of this request then I don't think the tapes going to survive very long, if he indeed take the money. By the time they get the access request the tape may have been overwritten anyway.

    I think I would visit the store tomorrow early morning (the late night security guard hopefully won't be on shift then) and see the manager/owner, and hope they care about whether their staff are honest enough to get the tape out and play it right then in front of you.

    If security guard is dodgy enough to steal from customers he may steal from the business as well after all.
    On the other hand the tape might completely clear the security guard and all will be fine.

    Well, I was in the store with my mate, got my money out, took out a fiver, put it back (so I thought). Walked out the door with the food and ate it right outside the shop door (CCTV may even show me out the window). Finished, putting my rubbish in my pocket, mate walked off and got a taxi, then I couldn't find my money. There was nothing on the floor around me. I left. Yes, I should have gone in there straight away but I didn't click at the time, hence me going there the morning after.

    Well I'd call that clear theft if he's just picked it up, put it in his pocket and not reported his "find" to frontline staff/manager.
    I'd expect to get it back if CCTV shows the security guard or other staff member taking possession of it.

    If it shows a stranger (non-staff) picking it up, well... at the end of the day if I was walking down the street and saw £55 laying there then you're going to do what you're going to do so you can't blame him/her too much :rotfl:

    I think Custardy is pointing out that you cannot prove what the security guard picked up. I doubt that the picture on the CCTV will be good enough to identify.

    The security guard could claim it was rubbish. This is all hypothetical anyway.

    CCTV is sometimes very clear. My husband's car was damaged by a vandal a few weeks back and we obtained the footage of him doing it. He admitted it, and he's now paid for the car to be repaired. Fortunately, we knew who he was (long story - he didn't know it was our car, and he was in a bad mood!!).
