Tsb Card Protection reclaim

Good Morning,

Just looking for some advice really to do with reclaiming card protection/PPI from lloyds Tsb on my credit card and general time scales at the moment.

I originally wrote to Loyds in early November 2009 requesting a full refund of all payments for ppi made on the account going back to 2002. I received there reply within 2 weeks stating they would look at the case and get back to me.

I eventually got another letter after the 8 weeks had elasped stating that they had been unable to reach a decision within the 8 weeks allowed and that i would now be entitled to go the FSO if i wished although they would expect to respond within a further 3-4 weeks.

I did write to the FSO with my complaint in late Dec09 which has been received but is waiting for somebody to look at the complaint.

Obviously we are now mid March and i have had no further correspondance from Tsb and even after phone calls to Lloyds I get told my case is waiting in a que and that they are unable to give time frames.

My question really is to find out what timescales other people have had to wait with lloyds tsb with regards to ppi on credit cards.
Perhaps i am being a little premature thinking that 5 mnths is sufficient time to receive a final decision from them.

I would be gratefull for any comments and feedback on timescales

    With my own personal experience of LLoyds they can take longer than the normal 8 weeks.

    One of ours was about 12 weeks but as they did let us know, we were willing to wait, as the FOS can take a very long time too.

    However my credit card with lloyds taken out in 2001, was successful through the FOS over a year ago and Lloyds have recently (a few days ago) from sending the 2 loan ppi complaints to them in approx Nov 2009, and they send letter and did uphold in our favour.

    You may find that you have not heard anything further from LLoyds as the FOS have been in touch with them for information from them about your complaint, as they require info from both sides before going in the queing system for a adjudicator.
    So due to this LLoyds may not be looking into your case any further as its with the FOS, you could though ring the insurance dept within LLoyds to double check on this.

    Ok thanks for your reply. I didnt realise that once the FOS were involved that things were dealt with differently. I will ring lloyds again just to confirm that this is the case and will keep posting any progress.

  • i beleive that the ombudsman are choca bloc at the moment and cases are taking 10 - 12 weeks to be passed to a handler, you may have a bit longer to wait. Good luck

    At last,eventually received a reply from lloyds tsb with regards to my card protection reclaim on the 20/03/2010 although not the news i was hoping for. Letter received stated the usual jargon of "we feel we did not mis sell etc etc as you signed the credit agreement therefore we will not refund you payments". I was sent a copy of the original agreement which is of course signed by me and there is a tick in the box stating ppi requested although i did not fill the form in myself it was filled in by someone in the branch. There is only 1 signature on the bottom of the credit agreement and not a signature box against the ppi request which i thought was common practice.

    My claim is with the FOS so hopefully they will decide in my favour when they eventually get round to my claim.

    Sorry to hear this.

    Was the the final response?

    That was a standard letter you received from LLOYDS, I bet they did not even take their time to properly investigate your complaint.

    I was to say if this was not the final decision, then you could write back and ask them to reconsider.

    Otherwise if its final and they have enclosed the FOS details you are right in to moving on with these.

    The letter received was there final decision so unfortunatly i cant go any further with Lloyds at the moment.

    I have spoken to the FOS this morning to update them and to request approx timescales with them but only told that they try and resolve all issues within 6 - 9 mnths so not really much of a guide.

    I have also spoken to Lloyds again today to explain that after receiving a copy of the original agreement i can see that the application was not filled in by myself and that the document i signed had the ppi box pre selected for me and that my complaint of this not been properly explained to me still stands.

    Obviously there reply was "you have signed the agreement so there is nothing we can do".

    The fact i have indeed signed the application and stupidly not noticed the ppi was added will i think go against me.

    Its down to the FOS now so can only wait and hope.

    We did actually get an overturned decision with LLoyds which was originally a final decision, as we raised a few issues with them and did not believe they investigated our complaint properly, however though it was an offer, and they overturned into a decision of upholding in our favour.

    Paul I too have had this problem with lloyds but for a loan PPI..I got that same lette, and a cpoy of the agreement which states optional PPI and there is a computer generated 'X' in the yes box, and ihave signed it, however there is a "please Note" box on there saying I must read the terms and conditions before signing..so therefor would have been expected to do it in branch (cant actually remember as it was 2001)..however I m a member of the armed forces so the insurance wold not have been fit for purpose for me as I am unlikely to be made redundant, and the MOD cover the first year of any sickness/ injury etc so if this had been made clear by the person selling the PPI ( which they have an obligation to do)I would have rejected the purchase on those grounds...so i have sent a letter back to lloyds stating as much, even though i received their final response, and now i have contacted FOS

    Thanks for your responses.

    I have written another letter to Lloyds in reply to there final decision requesting them to reconsider there decision stating that i feel they have not treated my complaint fairly due to the fact that i had not completed the applicatiion form myself and that it was there own staff who decided i needed PPI without explaining it nor giving me the option of declining said cover etc etc.

    Possibly wont make them reconsider but at least they will be aware im not prepared to give up and will keep on at them for as long as it takes.
