    Eventually got a call from the FOS yesterday ( 6 mnths after initial letter to them) with regards to my reclaim for CC ppi and after a chat with the adjudicator they are writing to Lloyds to advise them to uphold my complaint.

    Could be good as this claim was for about £2000 + but as advised LLoyds could still appeal against the decision from the adjudicator so will hold off on the celebrations for now.

    Either way were inching closer and its at least good to know that my complaint has reached the top of the pile with the FOS.

    I'ts been a good week so far, with the upheld complaints from HFC and now the FOS advising Lloyds to up hold on CC PPI. Just waiting for a final decision from Black Horse now on a further 2 claims but they have another 2 weels to respond so lets hope my good luck continues.

    Its certainly your week this week, well done!:beer:

    And remember as well, if LLoyds ignore the decision, it will be moved on to an ombudman, they do mostly go by the adjudicators decision, and you will also be awarded further redress on top for distress and inconvenience.;)

    Good Morning Di,

    Can you tell me how the refunds are worked out with regards to PPI on credit cards. I have the details of all the payments i have made towards the ppi and dates etc.

    Is the amount paid refunded plus statutory interest at 8% per annum for example a figure of say £74.77 charged in a month would be £74.77 x 8% = £5.98 x 3 years = £92.71 total.

    Im a bit confused as to whether the interest charged on the card balance each month which would obviously include the ppi is also refunded or just the statutory interest or does the minimum payment made on the account each month first cover the PPI and then the remaining balance.

    Also do you know of any site that i can get a spredsheet that works out the refund for me.

    I understand this differs to loan ppi, but below is the link on how the FOS calculates refunds, on cards and loans etc, hopefully this will help, and hopefully Robbedofmymoney will be along to check this out for you too.

    its not as straight forward when calculating the 8% simple as you have suggested above.

    on credit card refunds the 8% simple interest only gets applied if your account would have gone into credit once the ppi has been refunded to it.

    effectively they will produce a statement for each and every payment you have made for ppi, they will then add on the contractual interest that was applied to these charges.

    then they will produce a "ghost" account that would have been your credit card account without the ppi and associated at all, if this "ghost" account is in credit at any time then you will get the 8% on this amount only. this si in line with the FOS recomendations.

    so if you have only made minimum payments the chances are the account may not have ever been in credit so there could be no 8% refund.

    with credit card refunds it normally better to wait and see the statement and offer they produce and then comment on it

    Hi,

    Just got back off holiday and had received a letter from the FOS with regards to this claim which basically said that although the Adjudicator had upheld my claim against Lloyds and wriiten to LLoyds to advise them they had not responded to them within the 14 days allowed therefore it has now been passed to the ombudsman and also they have told lloyds to pay me a further £200.00 as compensation.

    Has anyone got any idea how long this might take from adjudicator to ombudsman. Am i looking at another 6 mnths or so as this was the time scale from compliant to adjudicator or is it quicker.

    Good Afternoon,

    Just looking for some advice really.

    I have just received a letter from Black Horse with regards to my PPI reclaim with them stating that they have upheld my claim and will pay me back all premiums plus 8% interest but they have not given a figure of what that will be. They are asking me to sign the form accepting this and send it back to them. After speaking to them they have told me that they do not collate the figures untill i have accepted and that once they receive my acceptance form they have 10 weeks to repay the money.

    My question is whether this is standard practice as they have already take 10 weeks to send me this letter upholding the complaint which means it will take up to 20 weeks in total to settle.

    Is this correct? and if not not what can i do about it.?

    Would be grateful for any advice on this one.

    Hi there and well done on your win, this is getting to be standard practice now, they redress as fos do, so you should not lose out.I have not had dealings with black horse but many on here have and maybe they will reply as to the time scale for pay out. If i were you i would get your acceptance posted off, as the quicker you do the quicker it will be sorted. x
