How would the distance selling rules apply if the person was in the dealership to pay the deposit, and the car was merely being brought from another branch of the same dealership?

I see your point but there is an agruement that the whole point of distance selling regs is to protect consumers when they enter into a contract without having seen the goods and give them the right to change their minds once they have seen them.

Most dealerships I've come across will refund a deposit (if the car hasn't already been ordered, specced etc) as a goodwill gesture. Most of them realise that to withhold the deposit would create negative criticism and negative word of mouth.

TBH this is the one area I agree with the traders on. I personally have never bought a car from a dealer (unless they were a personal friend) and the only dealinfgs I had with them was trying to buy for the MIL and we ended up leasing online.

All my recent dealings have either been leasing all sorted out online or write-offs all bought site unseen online.

If I did have to go to a trader I'm not sure my blood pressure would cope.

Pay deposit = I have agreed to buy car and don't expect any further negotiation, if I don't complete I fully expect to lose deposit.

But I think this is symptomatic of the society we live in today where we expect (whether rightly or not) no quibble refunds.

I agree to an extent that once you put down a deposit you should be committed. The only time I've had a refund is when I ordered a Smart Roadster unseen back in 2002 and made the salesman write down the refundable nature of the deposit if I didn't like the car.

This would be the exception. You have stuck with the guy and he will be happy with that.
  • What will the Park Royal MB dealer say or do should someone there see this thread, when it turns out they didn't cheat the customer?

As he was charged a deposit without having seen the car, he is perfectly entitled to request his deposit back in full if the car is unsuitable.

Whenever someone asks you to put a deposit, assume that is non-refundable unless you get a written promise otherwise.

If you intend to shop around, do that before rather than after you pay the deposit.

Try to be happy with the car you buy, not at what price because your car will deprecite ~10% (~25% in case of brand new) immediately you drive out of dealership.
Happiness is buying an item and then not checking its price after a month to discover it was reduced further.
