    No, not everyone loses at tribunal, but the majority of decisions go in the departments favour.

    The DWP arent required to consult your healthcare posse but they will look at evidence if it is presented to them. The fact that someone is sick doesnt mean that they cant work - the assessment is about ability to work - not whether you are sick.

    So if they decide that you are fit to work and so will have to start claiming jsa or nothing, then those are your ONLY 2 choices.

    You may dislike it, but they are the decision makers, and so what they say is law. :)

    Actually, there is the option of appealing, or claiming again with a new health condition. It s not just the two options you mention.

    when you have your medical and fail you appeal that fails then you say you wont to go to tribunal i did have reall bad depression and they failed me giving me 0 points the desion maker also failed me then i took it to tribunal and the agreed with me and awarded me 21 points so it is worth pursueing and while you are waiting for tribunal you have to make newish claim for esa at the basic rate but if you will it gets back dated trouble coz they can see you on the outside working ok but its wots going on inside your head thats the problem .

  • Surely even with your pyschological problems there are some basic jobs that you can do like road-sweeping, bin collection.. ect
    Which wouldn't require you to interact with any customers, just do basic manual tasks.

    Bin collection does actually sound like the perfect job for somebody who has hallucinations, can't be relied upon to perform basic tasks or necessarily even know what century they are living in.

    yes it is make sure when you go to tribunal get a medical reprt from ya doctor to support your appeal at tribunal

    keep your chin up heros as the atos are crap basicly when i went for my second mesical they passed me lol when i had signed off and got a job so goes to show they dont know much lol
    they just have to reach targets

    Pages and pages of detailed medical evidence was presented to them. They refused to look at it.

    Two doctors have written reports confirming that a) I am very sick and b) I am not in a fit state to work.
    I'm sure they looked at it and decided it wasnt sufficient to change the decision. It will go to appeal now and you will have your chance to have a say. You have a better chance if you attend the appeal in person.
