I have found out that you can legally claim no matter if you were in an IVA or not.0

Found out today that there is nothing stopping you from claiming back caharges from loans and credit cards that were part of an IVA and all funds will be paid directly to yourself, claim forms going out in the post pronto!!0

From whom?
I would say that the credit card company have every right to offset any reclaim against monies written off. You cannot simply change history and have the benefit of it(I hope that makes sense).0 -
Where have you got this information from? I find it hard to believe that the bank's will give you money if you're in an IVA, they may refund charges to reduce the balance, but this is to minimise their loss, not to benefit you.Getting married 02.08.14

The only benefit WOULD be if the amount of the charges are higher than the amount written off as a result of the IVA. Otherwise there is no point to pursuing it imho.0 -
I would agree with natweststaff memeber and believe the courts and FOS etc would have little truck with people trying the above. I think this would be relaiming going too fas and I'm totally against the banks.Mixed Martial Arts is the greatest sport known to mankind and anyone who says it is 'a bar room brawl' has never trained in it and has no idea what they are talking about.0
