Climing Credit Card Charges Even If Been In An IVA?

  • Where have you got this information from? I find it hard to believe that the bank's will give you money if you're in an IVA, they may refund charges to reduce the balance, but this is to minimise their loss, not to benefit you.

  • Spoke to a company today called Tyler Morgan who only deal with IVA's and are also regulated by the ministery of justice and they assured me you CAN claim all charges and you recieve ALL refunds. I find it hard to believe so called experts on here giving so many people advice really seem to no nothing about this.
  • I would agree with natweststaff memeber and believe the courts and FOS etc would have little truck with people trying the above. I think this would be relaiming going too fas and I'm totally against the banks.


    I also spoke to the FOS and they said there was no problem at all, like i said before, rimg and ask them. Sounds to me like some people would begrudge me claiming these unfair charges back because i was PREVIOUSLY in an IVA but you have no idea the reasons behind why i was.

    So why did you remove it? What difference would it make to you if the lenders lost out? Its not like they never profited from me or anybody else they were ripping off!
  • One last question: were there any amounts written off from those credit cards you are now reclaiming from?

    The credit card companys sold the dept to collection agencies, why what difference does it make?

    I think what he is driving at is if say the credit card wrote off 2k, and you claimed a similar amount in charges they'd refund the charges to the account so you wouldn't see a dime.

    This company you spoke to do they charge fees? Why have they taken such an interest in your affairs? Did you ask them to?

    What does the company gain from this then - I presume they aren't a charitable organisation?

    Here's some expert advice from their newsletter:
    Late Fees /Over Limit Charges on Credit Cards
    Claims can go back six years for the difference between the charge levied and £12, so a charge of £35 would generate a claim of £23 (£35 less £12) plus the interest charged as your balance has gone up plus Statutory Interest of 8%.
    Less their fee of £6, ie £17. Whereas doing it yourself will generate £35 net

    I'd say the previous advice stands, if its more than was written off then it might be worth doing, but seriously the info re credit card charges has been around how long now? I would hope most people considering an IVA would look at that first.
