Climing Credit Card Charges Even If Been In An IVA?

  • The credit card companys sold the dept to collection agencies, why what difference does it make?

    Because if any of the debt was written off then the original creditors would have the right to deduct charges from the amount written off.
    Is that a YES or a NO?

    I am trying to make sure you are not going into this blinded by this and then later on ask what you should do. If you are happy that the risks are there and you are happy to proceed then go for your life and update this when you have done the claim, ok?

I've nothing to loose by trying, i read a thread on here a couple weeks ago someone in same position as me claimed and won and i recall you (NATWEST) and a few others seemed to be saying he shouldn't have recived anything. Why is that? Do you know 100% that we shouldn't recive anything back? I'd say good luck to anybody trying to get back at the banks but seems some people on here seem a little selfish, its a sorry world we live in these days.

    I'd say the previous advice stands, if its more than was written off then it might be worth doing, but seriously the info re credit card charges has been around how long now? I would hope most people considering an IVA would look at that first.

  • You'd have to ask the credit card provider that, all i know is they sold the dept to a collection agency who then recieved money from my IVA. Are you saying that if my debt was sold to the collection agency for less than i owed i cant claim anything back?

    Find out if they wrote off any of the debt and if they didn't then I would agree that you get the lot of charges.

  • Can i just say then, would you have a look on the website 'Tyler Morgan Ltd' look at the loan section and read what it says in the last paragraph, i can't see why a company regulated by the Ministry of Justice would say something like that if it cant be done. can you??

    I won't go to a claims management website since that would push up their hits on the WWW and therefore meaning others would turn to a "claiming charges" website for something that they can do themselves with the help of MSE.

    Until recently, Cartel were regulated by the MOJ so whether they are registered or not is not entirely irrelevant but not exactly mind blowing.

    Seriously i doubt you looking at that website once is going to make a big impact! So are you saying the MOJ is no good?

    Funny, I just came on here to do a post about this. My fiance settled a debt with Capital One credit card in 2006-like you say not the full amount-but a settlement fee. He recently claimed unfair charges agaist them and was told he would receive £690 back...when the cheque came it was for £353..when he tried to find out what was going on, he was told capital one had taken out the rest of what was owed! So yes, you can claim..just be ready for them to lessen the amount

    Thing is on his credit score, Capital One is down as a default as he paid a settlement but now he has paid it all and its still there on his score.
    He is a couple of hundred pounds better off now though so cant complian really...
