Hi there
I am not certain on this but below somewhere is a loancheck thread and maybe it would also help if you checked on there and post this up on there if you want to, although I'm sure someone will see your post here and offer some help on this one for you, good luck.;)The one and only "Dizzy Di"0 -
Just thought I would start this just to see how long people are waiting to get their upheld decisions through the FOS settled.
I have won that has been with them since Dec 2007 original decision made April 2008 partial settlement July 2008. From that point it went to the Ombudsman for a decision concerning successive loan settlements.
Anyway Decision was upheld 21 Sept 2009 to date this has not been settled by Barclays. This is coming up to 6 months.
Can anybody beat this:D
I am having the same problem FOS agreed in my favour. Myself and Barclays signed a contract and I was to be sent a cheque within 4 weeks its is now a further month and still no cheque and Barclays are not responding to FOS emails.
FOS said there is nothing that can be done except give them MORE time and then take it further...... so well done Barclays you know how to play the game called buy yourself some MORE time very well.Official DFW Nerd number 227

My hubby also having this problem, his lloyds tsb credit card been with the FOS since 2008 and it was upheld and moved on to the ombudsman in 2009 because lloyds totally ignored the adjudicators decision, it was then upheld again by the ombudsman himself in Oct 2009, hubby signed the acceptance in Nov 2009 and the FOS have been since chasing, however I contacted the CEO of LLoyds on behalf of my hubby and after the FOS have been chasing and waiting for lloyds to contact them back, yesterday the FOS confirmed they are aware the CEO is now involved and LLoyds state the refund should be with hubby this comimg week - we shall see.
Blimey you have been waiting a long time as well then!
Good luck with yours. The one and only "Dizzy Di"0 -

Yes you are quite right they are playing the game. the only thing I would suggest is ring twice a week. Do you speak to Debbie when you ring?:mad:0 -

I long since gave up talking to Barclays they refused to meet me half way and knock off £400 for unfair interest charges despite me being in a DMP, now it has cost them much more they get charged £400 by the FOS because of my complaint have had to write off £700 debt and send ME a cheque for £450 whenever that will happen.
When I phone FOS I get put through to my case worker Richard Mathers.Official DFW Nerd number 227

Just found this for you maxdp in this FSA guide
3.12 A number of industry responses argued that the guidance appeared to require a
firm to assess all PPI sales ever made by it to the complainant. This would be an
unduly broad and onerous requirement and would take in sales of PPI on completely
different credit products that were not relevant to the sale complained of, and may
have taken place long before it.
Our response
The revised proposed guidance clarifies that our specific concern is where consumers
refinance their personal loans and with each refinancing firms sell, and potentially
mis-sell, a new single premium PPI policy – so that the consumer is soon bearing the
cost (within their loan) of two or more previous single premium policies. We now
make it clear that the seller should review the sales of all the policies it sold to the
customer in the course of this successive refinancing (only), and take all of them into
account, including their cumulative impact, when potentially redressing the consumer.
