What a suprise!!! Mardennis Limited are now in administration.I received my letter today from Armstrong Watson,Accountants who report that www.surpluswine.co.uk and 3 York Place,Leeds now have insufficient funds and I am an unsecured creditor. Fortunately I had to pay by credit card (over £100) and I am awaiting a refund from my cc company.0

I paid by Mastercard to the tune of £170. My issuer Capital One had suspended the transaction prior to the outcome of the chargeback rules - as they in turn pass the chargeback to the merchant acquirer of the transaction (Paypal/ Natwest Worldpay/ Barclays Merchant Services or whovever the acquirer of Mardenis' transactions were) .They inform me today that Mastercard have REJECTED the chargeback under their rules, as I understand the merchant processed the transaction through unauthorised means(?). Capital One intend to take up the matter further with Mastercard ' as they have a number of other cardholders in the same situation ' ... And there I was thinking the cardschemes protect the cardholder from fraudulent activity!
Maybe the battle for refunds for the cardholder is just beginning....0 -
I have been following this as I was caught out by this too. I received a letter from the administrators this morning. Fortunately Barclaycard have already issued a refund on my credit card even though I am not the primary card holder and individual items were not over £100 though I spent over £500 in total. I bought champagne to celebrate my son's graduation this summer. I might have ordered more but was more concerned that the wine might have been kept in poor condition rather than any scam! The prices were very good but being in the off-licence trade they did not seem that unusual compared to some of the offers we get in business. I'll be going to our usual suppliers now for my champagne.
Lesson learned though. Even though the advert was in very reputable newspapers you can never be certain and I will not be ordering like this again.0 -

I have just spoken to Debbie Bell of ArmstrongWatson, "Under the solvency legislation, I have a duty to investigate the Company's affairs and report on the conduct of the directors. If there are any matters which you wish to bring to my attention".
For Mr Lefranq to put a half page spread in the Times, Mail & Telegraph at the beginning of March and be in administration by the 26th March (Wine delivery day!!) is wrong, and he should be prosecuted. I have written off the money, but the principle is burning me up. I intend to email to ArmstrongWatson, as I hope all of you are. I will point out that West Yorkshire Police should be contacted by them as they obviously would like to speak to Mr Lefrancq.
Come on, lets have payback.0 -
Does anyone have the e mail address for WYP...from other comments about Trading Standards I don't think I'll bother with them!!
Mind you Watchdog is back on the BBC this week..perhaps I'll contact them0 -

The credit card company will initially issue a refund to your credit card and then attempt to retrieve the amount by contacting the merchant's bank. This process can take up to 60 days and if not successful, as may be the case here as the company has gone into administration, then you card will be debited with the said amount. If you are the primary card holder then you are covered by section 75, but other card holders are not. If this is not the case with Barclaycard then I would be pleased to hear from you as I too am not a primary card holder.lymorelynn wrote: »I have been following this as I was caught out by this too. I totally agree. How can a company/individual that places an advert in most national nespapers on 6 March and takes orders totalling millions then go into administration on 26 March? There was obviously never any wine and so no intention to deliver. This is FRAUD. What happened to all the money? Do the administrators know what they are dealing with? Do we or anyone know what has actually happened? There are so many unanswered questions. Meanwhile Mr Lefranq is somewhere with loads of our money. Irrespective of whether we may or may not get our money back there is a principle involved here. So let's all contact WYP and the administrators in order to bring Mr Lefranq to justice.jeff_tower wrote: »ArmstrongWatson- Mardenis Limited In Administration

I think this depends on the company. Capital One treats all cardholders the same, I asked and they wrote back confirming this.0
