I would also be careful about naming sellers on here especially when they don't have a high sales count as that can also identify your own account. Hi all thanks for your comments, seller refusing to refund item, just saying they will send it on saturday,reported to ebay who want to do sod all,they have also ended the auction.
My question is this,say they send the item, I have had problems in the past with counterfeit goods and paypal have given me 10 days to get the item varified, with written confirmation from the company copied that the item is a fake.However I have just rung the company for this item, and they would be willing to verbally clarify whether or not the item is real,in any of their stores but it is their policy not to issue written evidence of this, which I have been asked for by paypal in the past.So my question is if the item is a fake and i cant proove it to paypal what do i do??
SOOlin, is Fay the person who may be able to help with this??0 -
Frivilous fay is the guru of how to deal with a fake, I'm not sure i've seen her logged in today though.
I hesitate to offer advice about fakes in case I get it wrong, but I wonder if there is any benefit in emailing the seller again and saying that ebay seem to think the widget is a fake and to avoid the seller in any un necessary costs and expense with having it destroyed by paypal you would prefer to get a refund now and forget the whole transaction. Obviously this might not stop them and once again you will end up with the problem of having to get a fake verified, but that is the penalty really in risking buying from low feedback sellers with stock photos only .

PayPal wont accept and evidence verbally, if the manufacturer wont give you anything on paper (not uncommon) then go to a supplier.
When I purchased some fake Sony Memory cards I went to the Sony Centre in Town t to find that they has closed down – I went to PC World and get confirmation and the paperwork I needed.
Simply find a shop / supplier who sell the item (not knowing what the item is I don’t know how easy that will be…) and ask the manager nicely and submit the letter to PayPal.
If this cant be done within 10 days (This is 10 consecutive days, not working days) then file a dispute for another reason and return the item to the seller for a refund (dependant on weather you have already open a counterfeit case)
It’s a much better option to open a counterfeit case because if you win PayPal will request you destroy the item (they will make you sign a disclaimer) and refund your money – so that leaves the seller out of pocket – no money – no item.0 -
Feeling flattered that you all thought of me... but fakes are rough territory... the best I can usually offer on the subject is 'DON'T POST IT BACK!'
Being sent a fake would be pretty much the worst case scenario here. I'm going to reiterate what Soolin says - try to stop them sending it. Ring them if you have to. Tell them 'if it's a fake I don't want. I will know if it's a fake - save yourself the trouble'
Failing that, it looks like Steven has posted some good advice.
Paypal are notorious for being a pain in the butt when it comes to fakes - it's just not that easy finding someone to verify.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
Thanks for your reply! I cant do that though as the manufacturer only sells this item through their own stores, you would think they would want to help,to clear the streets of these goods, but they couldnt give a fig!
The only thing I had thought of was to file an item not recieved and basically not sign for or pick up item from sorting office so that it automatically goes back to sender, I have not recieved item therefore might get money back? Dont know whether this is a goer or not. I believe recorded items get sent back after they have been at sorting office and uncollected for a few days??
Any suggestions would be greatly appreciated!0
