I smell a rat!!

Hi,all,I made a purchase on ebay and item was advertised as relisted due to timewaster, I made an offer on the item and paid the seller. Item is a very expensive item that I would not expect someone to have several of.I e a designer item,that was advertised as an unwanted gift, there was only one. Individual claims to have reciept and will send a photocopy of this, so i was appeased .

I have come onto the computer this afternoon and see the item has been bought by someone else and then relisted,I suspect the individual is selling lots of these items, but advertising they only have one. I have emailed them to ask for my money back,as the item has been sold to someone else and I have filed dispute with paypal asking for a refund, I have told the seller that I can appreciate that they would want to sell the item to a higher bidder, and to go ahead as I am cool with this, I just want a refund, as
it all seems dodgy to me.

My main query is does filing a dispute feeze the paypal a/c of an individual? Or do I have to wait 7 days to escalate to a claim.

  • Ebayer has gotten back to me to say ebay won't allow her to cancel her advert for 24hours, but she is not taking anymore offers??? Is this making any sense??

    Firstly you can't open a full chargeback for 7 days, so her funds are free at the moment to be withdrawn, however if this is an ebay purchase you are fully covered . You are even covered against non receipt for a non ebay sale, but only if the goods you bought are stated on the paypal payment and you sent normal funds and not a gift.

    However can you clarify that you bought this properly though ebay as an acceptance of a best offer or a second chance offer?

    If this was a proper auction with bIN or a bIN with best offer then the advert cannot still be there so she is talking rubbish, if however you just made an outside ebay offer then she can sell as many as she wants as there is no record on ebay of the sale having gone through.

  • Thanks soolin! The sale is a best offer, but it has since been relisted again and someone else has bought the item,so the seller must have two items?? Which leads me to believe they are dodgy, I have called sellers bluff and said sell to the highest bidder and just refund me, im fine with that.

    Wait until you get your money back and it is all properly cleared and then don't forget to leave appropriate feedback. Also if they send you a mutual to reclaim their fees don't forget to decline it.

    Personally though I think they will come up with excuses not to refund you and hope to have the money out and away before the 7 day time limit for a claim. Keep an eye on them in goofbay as well to see if they sell it even more times, and it might be worth pointing out to ebay that a unique item has so far been sold to three different people.

  • Seller is just saying dont worry the item is yours, I HAVE CANCELLED THE other bid, can you do this on a best offer?? I said I would rather have a refund, but insisitant that i have item. However, theres still a relisted advert up there which she is stating will take 24 hours to disappear off of ebay, does this ring true?

    I had thought of not signing for the item when it arrives and having it sent back,I THEN HAVE AN ITEM NOT RECIEVED CLAIM??

    If you remove an auction from ebay it goes immediately so seller is telling you porkie pies. If you get the item then surely that is fine as you obviosuly wanted it, declining a signed for and tracked item often means a claim for not received is not successful, so I would be careful about doing that.

    Do you want to pm me the sellers ID (don't out it up on an open forum) and I'll see if it looks really suspicious, or just dodgy?

  • Seller is insistant and has just contacted me to say I am the high bidder and that, she will be posting the item out saturday and that there are no other items, we''ll see,I'll keep an eye on ebay for her adverts!

    The seller doesn't look right at all to me, stock photos and selling the same item more than once. Sending recorded not special for a very high end widget and has a history of a handful of sub £10 sales before this, all their other feedback is from buying.

    Also more worryingly, check out the completed sales via feedback, some items have already been removed by ebay.
