    I think thats probably good advice, lm still waiting for them to call me back 2 days later and they still havent surely a company should show more interest considering its pay day for them if it works out . I still have credit cards claims outstanding with this company but i let them do the work for those ones, they will actually have to earn there money this time but i dare say they wont. I did contact by email the ministry of justice yesterday to see if they could pass on any info about this company and i also left an emailed complaint on financial claims website about there service and that if i didnt hear anything from them then i would send of my acceptance of the offer because i dare say if i left it to them it would be another three months before i heard any thing!     Umbelievable i havent heard anything from Financial claims regarding my claim in 2 days since when they said they were going to contact me and all of a sudden 2 phone calls within the hour(after my complaint), shock got a feeling that ive managed to get some money back through having to go to other powers, money which when i spoke to them on the phone didnt even no that it had been offered? funny considering there dealing with my claim when i asked them how much it should have been from there calculations they couldnt even tell me and yet they stated they had got my statements from the bank. When i said the figure 9035 pounds she sounded in shock and said i should accept it no wonder they probably havent had a payday in a while and now they are going to get 15% for doing nothing.
    Well im apparantley going to get a phone call tomorrow (we will see) after they have spoken to there accounts, but im not going to accept that not for there not doing anything even 10% would seem alot for there service but would be more happier to pay that.
    Im sure they will come back with an even bigger fee charge though, if they do ill refuse to pay it and see what the FOS has to say about there service!!!!

    The claims management company are not one that is governed by the FOS so I'm not sure what you are trying to say about the claims company.

    Sorry natweststaffmember i actually meant the consumer rights authority/group. I feel the company which i signed upto actually hasnt dealt with my claims or shown very good customer service all the way through. Infact when i finally spoke to one of there advisers they couldnt even tell me how much they have been trying to claim (because they havent), not bad for a company what states they will deal with the banks about my charges.
    Also they didnt even no how much i was offered by Natwest? as a good will gesture which they should because i asked the obudsmans to keep them informed, what annoys me the most is that they have known about my situation of being in financial hardship since last July 2009 when i was made redundant and apart from filling out there financial statement i had heard nothing from them. Infact the closest ive got to any replys are infact from Natwest saying that because of the courts desicion that basically they had won.
    I refused to except that and dismayed with the banks aswell as my so called claims company i decided to complain to the obudsman. and ever since then things have happened and i finally got a positve result. The fact that i had to do all of this makes me wonder why i should then have to pay the entire fee to financial claims who in my eyes have done absolutely nothing. And to be honest im not concerned what they have got in there terms considering the unprofessional service they have offered.
    I shall be getting a call from one of there advisers tomorrow with which is when ill find how much im going to be charged.
    google financial claims uk and what youll find is 10% fee,
    Ive got paper work from them which states 15% fee for anything over 3000,
    And on there website it states 20%
    Gee i wonder which one they will try and charge me (try being the optive word)
  • The only complaint you have is with the Ministry of Justice that regulates CMCs. There is no such body that relates directly to customer services of CMC's which can be absolutely dire(which they should address since they take upfront fees yet are well known for poor customer service).

    Thank you for advice natweststaffmember im just trying to make sense of it all. The thing is they havent actually taken any money yet, probably because the claim didnt go through them otherwise they would have had control of what fee they were going to take, atleast now i can contest there fee due to the lack of effort they have put into my claims.
    As mentioned before i went to the financial obudsman because i felt annoyed with the letters i was receiving from Natwest and also the lack of customer service provided by Financial claims, it seems as soon as they got involved that things really did start happening. When i asked if Financial claims if they had been in contact with the obudsman they said they hadnt and were still processing the hardship claim (apparantley). Well it seems that i quicken up the process by going the route i did because i was made an offer, and financial claims on the phone couldnt even tell me how much they were trying to claim back so i was abit hesitant in telling them how much i received. Basically natweststaffmember i need your advice or anybody elses, how i can propose to financial claims that there service was inadequate and i refuse to pay the full amount, where do i stand on this surely and i complain to the consumer rights on the gov. website about this as the servbice they said they would offer was not actually given. I have alot of emails where i have had to chase up them for information , i also have 2 or 3 emails with them apologising for not returning my calls and emails.     Stop calling them and wait for them to write to you.

    Keep the £900 or whatever you think it may be aside in the event you decide to pay any fee they try to charge you.

    Complaints about the company should be made to info@claimsregulation.gov.uk - they are the regulators of claims companies. Send copies of emails etc.

    If the claims company try claiming the fee from you come back here, but for now accept the offer from the bank, pay off your debts and stick £900 odd aside so you have it if you do decide you'd like to pay them for their crap non service.

    esmerellda you are good!!! i didnt no aswell as good advice you could read minds. When they called this morning they stated the fee would be 10% so 913.5 not bad for them considering they had still been in the process of my hardship claim so thank god i did go to the obudsman otherwise id hate to imagine how long i would have been suffering. I was still wondering if i should pay them the full amount or not? if i go to the claims regulator what steps would i need to take?
    I also questioned them on my credit cards charges aswell, i was told about 7 months ago that they could claim them back and these would take shorter to claim back for around 6-8weeks and guess what im still here and hadnt heard anything. Well they will have to earn there money now, i asked the adviser how far these claims had gone and they said there were dealing with them (still!!!!!) so i asked them for a timescale? they said it would take 1 more month. So basically i took down the advisers name and details and asked them to email what they had just said. so we will wait and see because ill just hold on to that payment until the other charges have been claimed so its in there best intrest now ha ha

    Credit card claims are paying out on charges 9 days to 3 months depending what you want to accept as settlement. 7 months is bull, I would call your credit card companies and ask them if there are disputes on your accounts through that company.

    Usually pay after 2 letters, 1 in some cases (barclaycard), Cap one sometimes push it a bit and Egg only refund back to £16 and like going to court.

    And sorry - WHY are you still thinking of paying them £900 ?

    Think about it, what are you paying for ? Exactly ? Write a list of what they have done for you on that claim.

    1: got you to fill in some forms
    2: sent a letter of authority to the bank ?
    3: sent a DPA request template to the bank ?
    4: waited
    5: got a list of charges back from the bank ?
    6: wrote to the bank asking for the charges ?
    7: took a few phonecalls off you
    8: sent you a form to fill in to claim hardship ?

    that about it ?
