Any suggestions or help please!!!

Hello everyone, today i received an goodwill offer from Natwest which really suprised me. Ive been in financial hardship for months now so to receive the letter with the amount of 9053 pounds on it you can imagine my elation:j and relief after years of being charged real excessive fees so i wanted to sign the letter and send it straigt back to Natwest with a big fat Acception on it!!.
My problem is and this is where i need the advice?, is that i signed up to a company called Financial claims ltd in 2007 to try and reclaim back my charges i found there service very poor and infact in the latter part of my claim i found myself complaing to the obudsman about my situation of being in financial hardship and the way my bank had dealt with my complaint, yet Financial claims knew about my situation ages ago and i have felt they had done nothing about it not that they inform me of any progression or correspondence about my complaint. What do i do? do i send of the letter of acceptance to Natwest or do i have to send it to this financail claims? im happy with the settlement and do not wish for this to be on going. I rang financail claims this morning first thing to inform them that i had received a good will offer and all the call centre adviser did was jot down my cust ref. which he then replied a customer adviser would ring me tomorrow morning 24 hrs after ive made the original call, does make me wonder if they are legite?? please could any one advise me on what i can and cant do in this situation?? Thank you and people dont give up hope

  • If financial claims have not relinquished their role as claiming for you then whatever percentage you agreed to pay with them is payable unfortunately.,

I have no problems with paying there fee or any bodys if i felt they were the ones that had achieved this, and if they were i certainley wouldnt know about it because they never send any correspondence. The problem is when i was receiving letters from Natwest stating that the case were closed i refused to believe this considering my unfortunate position of being in true financial hardship.
So i took matters into hand and wrote a letter to the obudsman and since they have got involved things started to move forward, i did also request that Financial claims were kept informed due to there terms. Yet Financial claims i feel would never have taken these steps and i would have been lingering on for another couple of years if not more still struggling . Like i said i rang them to advise them of the goodwill gesture and instead of dealing with me there and then, they said they would call me back in 24hrs?? I mean i would deem this offer as a success and im chuffed to bits and wish to except it but, in financial claims terms it says to be on guard of any goodwill offers and to notify them as soon as it was received which is what i did. I have actually emailed the ministry of justice to see if they are a legite company aswell to be sure. Thanks for your reply natweststaffmember

Hello esmerellda it is the bottom one i believe. They state they have offices in middlesex feltham, but it also says st julians avenue st peter port. Im expecting a call from them today so i just want to make sure its ok to go ahead, and whether im aloud to except the offer, or will they try going for more therefore jeopardising my chances possibly of reclaiming what they have offered. Any suggestions would be grateful

You documentation should have the registered company number on it to clarify.

The registered address may be entirely different to any trading address. Whilst it is possible for 2 different companies to have the same name (where one has already been dissolved), each has a unique registration number.

I would be surprised if the company you did originally engage in 2007 was the bottom one, since that was only initially incorporated in September 2008.

(It could be that this company had taken over the business of a previous company, but you should have been made aware of this)

Hello Premier it defiantley has on the paperwork at the bottom of the page a first contact address which is feltham middlesex, but then when you continue it also has the address st peters port and as stated by esmerellda it also has the authorisation number crm6254 at the bottom aswell. I tried looking on the ministry of justice website but couldnt find it(thats not saying that i may have had trouble finding it) have asked them to send info to me though about them.
Also i did start proceedings with them in 2007 because thats when i started my claim.

Ive also got on to there website and filled out a compliants form because im so un happy with the way they have dealt with my claims in the past and future. Hind site is a wonderful thing but if id none what i do now i think i would have gone it alone as a company they never inform me of any news and seem laboured in there efforts to get back my charges which surely would be in there best interests aswell. I signed up to them because at the time in 2007 they offered the best percentage fee for trying to win back the claims and also i did not want the hassle to do all the paperwork so i signed them up.

Ummm offshore company - personally I'd avoid like the plague.

CRM numbers seriously mean sod all. I mean don't use a company without one, but just cause a company has one doesnt meant they are legit.

You obtained the refund on your own. Let them sue you for their 'cut'. (probably not great advise but its how I feel about these companies) You employed them to do a job and they failed miserably and gave you twice the work - dealing with them AND running your own claim through the FOS.

A 50% offer on refund of bankcharges is bloody good in the current climate so unless you fancy a risky, long protracted court battle and a risk of costs, then I think I'd take it, especially if you are in hardship.

Just my opinion, others may think entirely differently.
