cat c write off mot valid

hi there iv recently brought a car off a trader. after the 6 mile drive home the car ceased to work. called out the aa and was advised buy them the car had been in a bad front end smash, the cam pulleys were out of line which in turn chewed the cam belt in half. there were wires dangling showing bare metal basically car was knackerd. iv had advice from trading standards and have sent him a letter asking for a refund. i hpi checked the car when i found out it is illegal to sell cat a and b write offs. and found out the car was cat c. the car was sold to me with tax till may is it possible being a write off this mot is void as no checks have been done on the car either, just thinking it was advertised with long mot so i can also get him for false advertisment

A Cat C car does need to be VIC checked.. To ensure its safe to be back on the road..

The tax is not an issue as any previous tax remains valid when the car is written off and it can be retaxed once it's got a VIC
Two things come to mind, first is that under sale of goods you are entitled to reject the car and get a full refund. Trading standards will advise.
The second one is that’s it actually a criminal offence for a dealer to sell an unroadworthy car. I’m not sure who prosecutes this, could be police, could be Trading Standards.0 -

in basic terms when its written off by insurance the v5 document is sent back to DVLA. If you buy a cat c car the mot on the vehicle at the time is null and void. You need to get the car road worthy so it will pass MOT again then you need to book it into the VOSA station in order to get the vehicles identity checked against what the DVLA hold againt the registration of that vehicle. If it passes the check a new v5 will be issued then you will be able to tax the car.

If it’s over three years old a car must be MOT’d when it is presented for the VIC.
The MOT can either be the original one (which remains valid until normal expiry even if the car is written off) or if that’s not available or run out then you have to take it for a new one before the VIC.
Once you have the VIC then car can be taxed in the normal way.
Also worth noting that as long as the old tax & mot are still valid a CAT C car can be driven legally on the road (subject of course to the normal roadworthyness and insurance requirements). You only need the VIC for when you need to renew the tax.0 -
I can tell you now 110% that not all cat C's require a Vic check. How do I know this?
I am a legitimate licensed motor salvage operator who buys and sells salvage vehicles, most sourced from insurance companies. I bought 14 last year that were cat C and didn't need a vic. Vosa will tell you whether there is a vic marker on the vehicle if you ring them. Also you can use tha ask gov site, do a vehicle details enquiry (its free) as if you were looking to re tax the vehicle. This will say if there is a vic marker. Also the cat C's that don't require a VIC test have no markings on the log book. The ones that have had a vic come back statingt that the vehicle has undergone repairs following a crash/claim. They do still show up as CAT C regardless of the VIC test when you HPI them.
