    wow, thats can't have been good. In the letter it says they are not insured???? well thats a bit stupid, plus not being insured doens't make you any less legally responsible.

    What they mean is they don't take out insurance with a company - they chose to pay the claims themselves. The councils I used to deal with had insurance once the total amount of their claims paid out exceeded a certain sum.

    As you say it doesn't absolve them of their legal liabilities.

    The state of some of my roads are disgusting, and since christmas i've seen repairs carried out on perfectally good roads leaving those in a shocking state to get worse.

    I made a telephone complaint 2 weeks ago, than a week later an email, naming the roads and expressing that should my car become damaged due to this i expect them to pay the bill.

    Well, low and behold i drove over it again last night (there is one i can't really avoide which is about 4 meters long) and something get wedged in my tyre, a loud hissing noise followed and pulled over to see an inch sticking out of the tyre (not exactally sure what it is)

    Anyway, been and taken photo's of the offending area this morning (can't post them i'm at work) and will be ringing the council. what are the chances there not going to put up a fight. Off to get a new wheel in an hour but i flipping well wanna make sure there paying for it, especially since i've reported it twice already and nothing done.

    Any advice. They also sent about 50 pages of defect reports and reports they had about the road all saying the same. The letter never referred to the meterial.

    Oh, i'm also assuming i should not have the personal details of other people who have made complants? emails, names, addesses etc

  • Just like to let you all know i finally recieved a reply. The council have decided it was wrong to deny my claim and apologised for the information they sent:beer:
