Property buyers who fail to complete off-plan deals are facing legal action from developers

I really did think it was pretty obvious, just most of the threads with the proper name seemed to get deleted.0

I read it and immediately pronounced 'Gomes' a vauely Mexican way........
Goh-mezz - as opposed to rhyming it with 'Homes'
That must tell something about my education, I know not what.....0 -
Too much Addams Family, perhaps? No reliance should be placed on the above! Absolutely none, do you hear?0

MSE pulled my thread on Vent about the despicable Powermatic Beds of Leeds (aka More Than Mobility Leeds) and it's directors Lorraine Bryan, Damian O'Reilly, Amanada Goor, after a threat of legal action. Fortunately, the DTI then shut their company as a matter of urgent action and banned them all as directors for a long time, which kind of vindicated all the posts.
My point being, MSE have to be careful what they allow and are on tricky ground in terms of what is fair comment etc. I haven't read the thread in question, but I don't think it's unreasonable that they occasionally feel they have to remove threads, though I agree it does seem like they are giving in to bullying. It's just a shame the info isn't there to warn/inform others.0 -
Article below should make nice reading for the violin players.
The posters from the thread which was pulled, who were imagining they can make up the law the way they'd like to see it work
The ones who figured because an offplan development had not been completed in what they felt should be a reasonable time... that the buyers should be able to get their money back, cancel contracts ect, smack the developers in the nose for whatever problems they've encountered which have caused the delay.
If you're happy to take on those risks in the first place buying offplan - where the delays could be substantial for any number of genuine real reasons - then these are the risks which come with it.
If you don't like it - don't buy.. and certainly don't be stupid enough to buy without serious legal advice if the contract could subject you waiting a long time for the property to be completed - quite apart from ensuring you have necessary funds secured to actually pay when it is finished. It is pretty simple, even though the violin players try and make out you're practically blameless when caught out on delay/funds to pay.

That Daily Mail article is really a strong argument never to buy off-plan. It's ridiculous that the developer took 5 years to complete the development - 4 years longer than originally estimated. No wonder the solicitor who advised the buyer is sounding a bit edgy.
On the other hand, lots of people buy off-plan and it all works out okay for them. For me, it seems a big risk.No reliance should be placed on the above! Absolutely none, do you hear?0
