Say what mate? Are you saying you've formally requested the CCA and they refused you?

The actual letter you send is this and you need to send £1 as well: CCA Request

If you're having issues mate head over here: Unenforceability & Template Letters III

Or am I reading this wrong, and really you want them to send you paperwork agreeing to a repayment plan so you have documentary evidence?

NO i haven't requested the CCA this is in line with a conplaint on Overdraft charges. that extract was taken out of a final response letter dated 23 November 2009

Its now with the FOS but i was just wondering if you could clarify that little point.

Well it depends in what context mate - as I said, am I reading this wrong, and really you want them to send you paperwork agreeing to a repayment plan so you have documentary evidence?

If not, what do you need a contract for? A contract in what capacity and under what legislation? See why i'm confused? you're being way too vague mate lol :p

    Have you seen this: http://www.moneysavingexpert.com/reclaim/bank-charges

yes i wanted paperwork agreeing to the repayment plan not even much just a simple this would be the monthly amount, any interest that would be accured on the account or % rate, duration etc etc.
they are saying that they dont need to. But do they or do they not??

and yes i have seen that thanks Niddy

Hi mate - no they do not need to confirm it to you, there is no provision anywhere to enforce such action, however it would be polite and ethical as a business practice for them to supply it.

What i'd suggest is you do it and send to them, then put something on there like "I assume you accept the points above unless I hear from you in writing, within the next 28 days" - that covers you ..... but you'd need to post it recorded delivery so you have proof it was sent...

That stops them renegading the agreement. :p

as i said its now with the FOS so when i hear back from them i think it maybe time to even go to have a look into getting that imposed as part of the Act as this allows for even more detrimental and unfair treatment to consumers and creditors too

    Hi Maz,

I know you're itching to send off another letter but there's no need, really - just sit back and enjoy the break.... you're only half way there, a couple more letters and then they'll back down or take it to court! best get me sunday suit ready eh!? :rotfl:

Nah, we'll beat em out of court - pah, we're too good to let them take it that far - procedure and policy always overrules arrogance - remember that one ;);)
