    No chance - stop worrying, the debt is already unenforceable but we have to assume Monster did things right to date, so send the letter as advised and see what they come back with and let me know..... :D

    You looked at may Cap One and it was unenforceable, I sent the old version of letter template 3.1 after they sent an old application form, did'nt hear anything for a month, but now the phonecalls and letters demanding payment have started...do I send another letter or ignore?

    Just thought I'd pop in and say good morning to you and all your dedicated followers.

    Hi NID,

    Thanks about the last lot of advice with my Crap1 and Abbey cards.

    I've sent off the letter you recommended to Crap1 and have been in touch with Abbey.

    Haven't as yet heard anything back from Crap1, but the Abbey lot are saying that they'll take a part payment, and that this will be recorded on my credit file as a partial payment which reading through the rest of the posts I really don't want them to do. It's only been by phone at the moment and I'm waiting for them to actually send me through the letter they've said about that will give me my options.

    Also though (sorry), just wanted to check about my Barclaycards. They sent through reconstituted versions of the terms and conditions and didn't send through anything that had my signature on it.

    I sent through the "lets be nice" letter to try and get a proper copy of an agreement only to get back a "definitely not" letter.

    I'm getting letters and calls (constantly) from Calder, who I then sent through the "account sold while in dispute letter", but I still keep getting calls from them at least about 6 times each day on the land line and mobile. So it looks like they've ignored my letter.

    What do you think I should do next?

    Wait and see what they send back - regardless, you need to really wait til they default you and sell it to a DCA then you can haggle better.... but lets wait and see what they say before worrying - STOP SPEAKING TO THEM ON THE PHONE! :mad::mad::mad:

    That should sort them both out for now, but you have to stop speaking to these muppets! :D:D:D

    I'm getting the feeling (don't know why) that you don't like people doing things over the phone :-)

    Sorry - I consider myself well and truly told off, and will never do it again. Honest!

    The debt was for £15,000 and they've said that they'll consider "up to" £6000. Do you think that the DCA will be open to a better offer?

    Thanks about the letters to send to Barclaycard and Calder. I'll get them sent off today.

    £6k is a good offer, considering but before you agree you want it recorded as a FULL & FINAL SETTLEMENT. You need them to confirm the following points, within this template: Default Removal - Offer of F&F Settlement :D:D:D

    However wait for their letter and then we'll incorporate it into this one and get them told! :p
