You leave them a month to find the CCA. Its unenforceable anyway so why rush them? Until they now supply it, the debt is unenforceable. ;)
    Thanks NID

    hi NID
Just a quick question, if you remember me from a while ago and my hbos credit card. I cca'd them- recon sent, then application form sent(though not sure if legit etc, dut to the interest rate etc, though you said quick glance looked ok) sent query letter off, and have heard nothing from them in weeks, just got my usual statement through and they still adding whopping interest on, but havent passed it to dca yet, thinking as they so quiet court may be coming. but should I just ignore them at the minute? thanks,:(

Just ignore them for now - don't worry about interest either cos you can argue that later, it is effectively in dispute. But they won't take court action, if they do let me know and we'll sort it for you.... :D

    Hiya,

    Halifax - http://s900.photobucket.com/albums/a...r_pig/Halifax/

    Crappy1 - http://s900.photobucket.com/albums/a...r_pig/Cap 1/

    Tesco - http://s900.photobucket.com/albums/a...per_pig/Tesco/

Halifax = is this 2 accounts? I'm totally confused, sorry. Maybe you need to name the pages so I can understand them - I only need to see the CCA and signature page - anything else i'll ask for....:D

Crappy1 = Unenforceable. Send this: CCA Query

Tesco = Assuming at the bottom of page 1 where it states "Declaration" - your signature was there - it is enforceable. :o If it wasn't, what was there? :D

Hi K4j, Niddy is probably taking a well earned rest, but hopefully I can answer the above section for you as I am also dealing with Crap 1.

They too sent me the same application form with my signature on it and it also had the same wording as you've highlighted. However the key thing Nid told me was that it is not a CCA only part of an application form and therefore never intended to be the true CCA.

With regards to the rest of the wording it does not link the agreement to T&C's anywhere so you should be safe that this is just as unenforceable as mine mate! :p

Before spending any money though, I would wait for confirmation from Mr Doubt first ;)

    Thank you.

Any idea what i should do regarding the barclays one.
Barclays have passed the account on to the debt collectors and they have sent me a letter telling me to either pay up or contact them within 7 days or they will take further legal action. What should I do?

What is the current state of affairs with Barclays, have you CCA'd them and awaiting a reply? :D
