  • I need there to be a signature at the bottom of one of the pages, yours and theirs - it should really be at the bottom of the image that outlines the amount of loan, apr, repayments etc...... i.e. the actual agreement.

    Thanks Niddy

Thought the B/C was enforceable, but as you say nothing to lose so will send out letter and see what comes back.

The Lloyds one was an online application, but you had mentioned previously about a box that needed to be ticked and can't see one.

Thanks again for checking these for me :D

They also say that if proceedings were commenced by me on the basis that there was no enforceable agreement between us that they would strongly defend this.

So which letter do I hit them with next?

Send the new letter matey here: Refusal by Lender/DCA - to accept Unenforceability

Ahh yea I remember now, well then instead of a signature they should send the agreement with the tick at the bottom of it, usually it is found underneath the particulars of the loan on what looks like the agreement (i.e. the part that lists the loan repayments etc)....

Thanks Nid for your calming words. They will help me and peeps on here to relax and enjoy the lovely sunshine this weekend. You have helped me realise after reading all the posts that yes we messed up and yes we were stupid, but hey who hasnt in this life at some point. Through you, I found the confidence to stand up to these blighters and treat them with the contempt they deserve. I have a right to put the phone down and ignore these vultures. The original debtor has had their money many times over with all the interest they charge. So I say dont let them get to you by their unlawful pratices. Intimidation and using that to feed your shame and worry is their only weapon. I still get panic moments but I just come on this thread to get support from Nid and maybe someone in the same boat who is perhaps feeling stronger than me that day. Bless you all. Bless you Nid.:)

  • Thankyou so much! Think I may have made a mistake on one of them and paid a little, will check when, I think they were taken out at the beginning of 2005, this may be why the DCAs last letter was offering to clear £6500 for the loan and accept £2500. Not replied. Will go into detail later, but the sun is shining and the only perk of living in this dump is that the beach is less than 100 yards, so off for a few hours to wear the monsters out. Thankyou again, have a good day x

Hi Niddy, have checked all the pages and can't see a box ticked anywhere. I sent all the pages to you, the only part that mentions it is page 3 'Once you have signed this agreement and clicked the confirm button' is the only reference I can find to it.

Also in the letter that came with it they say 'We will not be entering into any further correspondence with you regarding the provision of copy agreements'

So would it still be enforceable if there is no box ticked? Thanks you are a star Mrs SNS

    Hiya

Not on your nelly - lol. No tick/siggy = unenforceable every time (on personal loans).

Basically if they are not entering into correspondence with you fine, ignore them then.

Just see what develops, if anything. :D:D

No worries Mrs SNS - nice to chat to you for once instead of the [STRIKE]BOSS[/STRIKE] trouser wearing version :rotfl: :rotfl: :rotfl:
