We have already sent the final response letter on 27th April with full copies of all Capquest correspondence though.....This has prompted the reply they sent which is detailed above.
So we send the same letter again??? The final response letter?

Right then, i will ignore Lloyds TSB. they did say that they will still persue (sp?) me for the debt but in the meantime will keep looking for my original CCA. Will let you know when the bailiffs are on the doorstep!

Hello everyone, hope everyone is having a good start to their week.
Looking for a little advice on a letter I've received from Red (Lowell in disguise) about my o2 account. I CCA'd them and they sent me back a letter stating that it is a service agreement & not a credit agreement, so pay up, is this correct? They said that I should contact the original retailer to obtain a copy of any agreement, but as the phone was bought from the o2 website then surely they should have it?!
Have I made a mistake in thinking I could CCA for a service agreement? It was taken out in 2006 so I think it suits the other criteria. Many thanks0 -
Aimsleey - I'm no expert but I'm sure I've read on the forums that you can't go for unenforceability on a service agreement only credit agreements.0
