    They will simply send terms or an app form which both are unenforceable lol - muppets!

    They sent me a "cannot locate CCA but we still want our dosh" letter, i sent final response a few weeks back on your advice :D Although, they haven't ever replied to it. They sold the debt to Lowells and you told me to send the 'Account sold' letter. (I just checked my spreadsheet and realised i haven't done this yet though, slap me please :()

    But if you've sent the final response, and they responded with theirs - great! that's the stalemate you desire. Forget about it now, its finished. However if they contact you again let me know yea, and we'll sort them out.

    Right then, i will ignore Lloyds TSB. they did say that they will still persue (sp?) me for the debt but in the meantime will keep looking for my original CCA. Will let you know when the bailiffs are on the doorstep! ;)

    Hello everyone, hope everyone is having a good start to their week.

    Looking for a little advice on a letter I've received from Red (Lowell in disguise) about my o2 account. I CCA'd them and they sent me back a letter stating that it is a service agreement & not a credit agreement, so pay up, is this correct? They said that I should contact the original retailer to obtain a copy of any agreement, but as the phone was bought from the o2 website then surely they should have it?!

    Have I made a mistake in thinking I could CCA for a service agreement? It was taken out in 2006 so I think it suits the other criteria. Many thanks

    Aimsleey - I'm no expert but I'm sure I've read on the forums that you can't go for unenforceability on a service agreement only credit agreements.
