    Hi NID,

In need of your expert knowledge again!

    Quick recap.....
Sent Capquest CCA - No response
Sent reminder - got reconstituted copy of part of app form
Sent query - rec reply that they had sent back to Cap 1
Rec payment req from Cap 1 then following your advice sent them full copies of everything sent to Capquest plus the final response letter.

Now received another payment requst aswell as a printed document of some terms and Conditions (8 pages in all). The front page has had our name and address typed in along with the original credit limit. The back is a blank copy of an agreement with no signatures on at all. (interestingly the paper has a small code on the bottom with 14826/RITCSLET/0809 - every co that I have worked for has used items like this with the last 4 digits generally meaning the month/year of item used therefore Aug 09 - cant be original copy if this is true here!)

    There letter states....

"I enclose a copy of your current terms and conditions.

As we have complied with our obligations under S78, we will not be entering into any further correspondence regarding the provision fo copy agreements. Your agreement is enforceable and we will continue to treat it as such.

We will continue to pursue the outstanding debt and do not consider this account to be in dispute, therefore would remind you that you are bound by the terms and conditions of your credit agreement and are obliged to maintain payments and repay your outstanding balance."

I was going to send them the terms and conditions letter but see that the wording is the same as the final response letter - so not sure how I respond now??

    Many thanks

    Nid, hiya :D

Finally got a response from the Idiots  at Barclaycard. (Omg i have so much hate for those clowns).... I'd sent a CCA Reminder over 2 weeks ago.

But having read it properly, they're saying a "copy of your current Barclaycard Credit Agreement will be sent under separate Cover". ... (current??).

This letter though, is going on about Civil Procedure Rules and court proceedings and some tosh. It also contains a blank credit agreement...?

Do you want me to post the letter up?

    Hiya Beenie

Nah, no need to see it - I have seen plenty of them! Basically wait a few days and you'll see they will send some terms (or application) - then we send a response, so right now ignore it lol :D:D

    Hiya NID,

Many thanks for your prompt reply!

We have already sent the final response letter on 27th April with full copies of all Capquest correspondence though.....This has prompted the reply they sent which is detailed above.

So we send the same letter again??? The final response letter?

Sorry....to question you but just want to clarify!
