Right mate, you have to trust me with this one ok? NEXT time they ring answer properly, go through security (so the call can be recorded) and document the time of call and ask for their name.

Then after you've passed security, stay calm and interrupt them speaking and recite the following, do not let them break you off ok? You have to complete it - as it is a formal warning prior to action and the call will be recorded (i.e. proof).

Say nothing else, then simply hang up. :D

    Thanks for the help, NID.

Do I still send the letter you recommended after this?

Yes mate - the verbal warning is just to get immediate action, i.e. your blagging them - they will record the call (all outbound debt calls MUST be recorded).... so they know you've warned them and they know they have a recording of the warning....

If you fail security or hang up the call is not recorded....

You're obviously not making a recording, but you tell them you are ;);)

Send the letter as a follow up....

  • Hi there I have been reading through most of the threads in here and its left me so confused.
I took out a loan in around 2002 with Lloyds Tsb, I then defaulted a year or so later eventually it was passed around to debt collection companies and it now with Link finacial whom I pay £40 per month.
Alittle while ago I phoned Lloyds up as I was interested in whether I could reclaim the ppi, only to be told they have no record of me having any accounts with them.
What I would like to know is could I claim the ppi as I really believe I would never have been able to claim on it and the lady told me at the time I had to have it and 2, can I request the original loan agreement from Link as I dont have any paperwork at all, I threw it all out thinking it would go away
Thank you in advance for any advice.

Yes you can reclaim - read here: http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

All the relevant info is there - the forum to discuss it/ask questions is here: Reclaim PPI Discussion

You have been paying for years - how much is left? Is this your only bad/defaulted/arrears account? I'd suggest reclaim PPi and interest (at 8%) and that will drop the balance somewhat, before considering unenforceability.... ;)

  • Well the original loan was for £10000 and I defaulted about a year and a half later then was paying token payments then I have now been with link for over a year now but still seem to owe about 9000 although I am only paying 40 per month.
  • sorry also I dont think I could go for ppi as the loan was more than 6 yrs ago thanks
