Oh and yes they can dip into NRP bank account without going to court I understand, and it can be a joint account.

Hi Kelloggs ... long time no see!

Is this "dipping into" facility available on all CSA systems? (ie, CSA1 and CSA2).

    Thanks

My nightmare started in the summer of 2008. They use the scare tactic of saying you owe thousands, without back-up because they can. Put the frightners on you, baliff letters then get LO.

I cannot stress enough to get your Data protection Files. That showed they used a confident address which was not valid from 1996. The arrears were £48,000, it was reduced to £25,000 and the Data Files show a liable figure of £4,000. All the data files show last attempted communication was 2002, it was only triggered because the overpayment period made it reach £50,000.

They expect you to play ignorant and pay up all the outstanding arrears. Last I heard from them was October last year, my daughter is 24 and it really is ridiculous. Probably hear from them out of the blue, but not much they can do.

They will only dip in if there is available funds i.e in credit .If you are in constant overdraft they wont touch it but they will target your credit card(s)

I'm confused with this dipping into accounts, it sounds like scare stories, the customers contract is with the banks, I could not see how if all or sundry (csa or not) can dip into peoples accounts or credit cards, I'm sure the banks are not authorised to do so and the other criminals would have found a way to do that to anybody with a bank account. :p

They looked at ours over a 28 month period, so there were overdraft charges etc etc, plus times when we were in credit?

There has been legislation passed which allows the CSA to take money from a debting NRP's bank account.

Where is this legislation ? I don't disbeleive you, I just find it hard to accept that it is not in my contract with the bank , usually the courts have to place an order to cease assets , and just on the whim or mood of the csa , ANYBODY here or in the UK can have their bank account debited by the csa after all it is not impossible for them not to make mistakes.
