CSA need money by 1.00 pm tomorrow

    Well, as it appears they do work on a Sunday, shock horror for all the NRP's!!, I suggest the above too.
    Its ridiculous that they demand an amount of money like that, and as other have said, you should be able to make some sort of payment plan to spread the costs, if in fact they are accurate...

    In the event that they try to go for an Order of Sale on your home and the NRP's partner has put in most of the money, then make an application to the Court under the Trust of Lands Act section 8 as it will not be contested by the NRP, and ask the Court for an Order to protect the money that the NRPP has put in. This then means if they get the Order of Sale only 50% of any remaining equity can be taken by the CSA. The cost in Court fees is £150. Do the CSA like this, no as it usually makes any attempt to make the NRP homeless to get arrears unworkable!

    dead end. nrp isn't on the deeds, so they're screwed.

    Then in reallity they can do very little to get at him, as Ballif action will also be out of the question as they will not be able to enter the property even if asked in the first time!

    Prision is out if he is paying as well, so it leaves passport and driving licence,. Travel abroard is doubtful if the CSA are taking as much from him as they are from me, and to stop him from driving will possibly cost him his job, which will mean that there is no money!

    In short they will have to talk and make an agreement, something that they are being forced into by me at this time, and they don't like!
  • We,, said man rang back, he wants to up our payments to triple which we have agreed but said we still need to find £18,000 now but has backed down and given us until Wednesday. We have said that we are willing to pay but cannot get hold of that type of money at the moment. He said something about enforcement and freezing our bank account. Where do we go from here. Can they just do that and what are we supposesd to do. Really do not know which way to turn.

    Don't let them bully you! If he rings again call the police and put in a complaint. As said get things in writing they do have to put things in writing , their word is not good enough especially at those sums :eek:

    That is totally incorrect. How can you deal with the threat of 18k if you don't have the facts stating how this debt happened?

    They MUST provide you with a letter outlining the basis of your partners conversation with the CSA chap, as well as a break down of arrears and how they arrived at that figure. Don't take no!

    Some of us who have the CSA t-shirt would encourage you to keep everything between you and them in writing. I would also send everything recorded delivery.

    As Kelloggs stated, things just don't go that fast, there will be legal processes that the CSA must abide by if the debt is in fact accurate. They can't enforce payment within a few days - how silly.

    Stop panicking - start to gather some facts.

    Which area of the country is this guy phoning from and also they should have sent you an account breakdown letter detailing all the dates of when the case opened up till now showing all the assessments and then the payments you have made to the pwc and what is left over to pay. they have to do that before threatening you with calls. You should also have received a schedule of the payments you need to make each month. Are you on a deduction of earnings order? If the caseworker has just recently set up one on you they should have contacted you to negotiate the arrears and they can only take up to 40% of your net monthly pay and 60% is protected. The arrears can be spread over 2 years at the most.

    If you get no joy then I would write to the complaints department
