DO NOT go round to your ex-landlord's house, that could be deemed harassment and you have no evidence of what was and was not said. If you go alone he and his wife could claim you threatened them, if you take a mate as a witness they could claim you went mob-handed.
Deal with this formally, i.e. in writing by recorded delivery so you have a full paper trail in the event that this ends up in the small claims court. Three days is not long enough if the man works he may not even have got your letter certainly not had time to go to the Post Office to send a reply, give him a week from the date he receives your letter (check online when it was signed for).Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0 -
Leon - have you actually checked with each of the three deposit schemes - DPS, TDS and mydeposits.co.uk - whether your tenancy deposit has been scheme registered? It sounds unlikely, given what you say about the LLs other shortcomings, but you need to check that first * before * writing to the LL about the return of your deposit.
If the LLs did not register the deposit, nor give you the "prescribed info" from the scheme, then they can be ordered by a court to repay the deposit to you in its entirety together with a penalty payment of 3x the deposit amount, plus interest ( minimal but..)and your court fees.
You may find it helpful to talk to the Council's TRO before running up solicitors bills.
Was an EPC ( energy perf certificate for this rental) shown to you at the start of this tenancy? Did it have a gas safety cert, if gas appliances/CH at the property?0 -
spoke to the LL today!
basically they admited to going into the property etc without my permision
said it only looked like i was living there and not my fiancee and child too!!
said the bath was scratched and so were bedroom units!?!?
if they were then WHY is a new tenant accepting this " damaged " property..
they knew full well i had keys and my contract wasnt over when i re-entered yesterday to make sure everything was ok..
i left them a note ( new tenants, see earlier reply )
now they say passports have gone missing?!?! WHAT THE ****
i can tell you now i would never ever steal anything so no way would i steal passports!!!
as far as i know there wasnt any there anyway, but i didnt go snooping to be honest.
so there saying they arnt returning any deposit ( wich they didnt protect )
are accusing me of theft!!
what the hell are my rights there?? i had a right to go in!!

Leon - stop pharting about posting on here and get on the phone now to your local Council's Private Sector Team and /or Shelter 0808 800 4444.
From what you have posted it is your LLs who are in the wrong on several counts: illegal eviction, failure to provide a Rent Book, failing to register a tenancy deposit.These are exactly the sort of issues that the TRO is there to deal with.
You say that your contract doesn't expire until today. Unless you have given formal notice that you were relinquishing the tenancy before tonight, the LL (a) had no right to enter without your consent and (b) certainly had no right to move a new T in to the property.
Had you chosen to stay after expiry they could not have served a S21 Notice of Intent to seek repossession of the property via the courts because no valid S21 may be served without the T's deposit having been registered.
You're wasting your time trying to talk to amateur LLs who clearly have no regard for their tenants, so call in the reinforcements. TROs need to know about LLs on their patch who act like this.0 -

Tenancy Relations Officer, may have other simiar title Private Sector Rentals Officer, Landlord Liaison Officer but essentially their role is to deal with LL?T issues within the private sector.
Make sure that any solicitor you may use is someone who is familiar with LL& T law.0 -
my solicitor is specialised in family law and also tenancy & letting etc.
only thing he has stopped doing is criminal law du to certain clients in the past.
i have been using him since i was a child
( well my parents too, for family law etc )
tried shelter, all busy at the moment, im popping out now to get materials for
a renovation im doing upstairs.
im determined to get to the bottom of this!

benifit forms
etc etc
and police have been notified!?!
i feel sick!

the LL wants to keep my deposit for "repairs" and have had people spying on me and my family and claming only i lived ther not me and my family!?!
i have not stolen anything!
what i did do was take the contract to show to my solicitor but that was returned today anyway, i filmed myself posting it back after they said they wanted it back aftr hearing what i used it for!
now they say passports etc etc are missing?!?!
this is just sickening if i can i will sue for demafmation or whatever!
i cant relax now knowing cops may show up at anytime!
i cant live my own life because of these people!

So where do i stand in regards with taking the contract even thought now its back with them?
As I said, they're accusing me of taking passports, birth certificates, etc.
Now I havn't done it all in writing because I havn't had chance because they were on the phone yesterday demanding I speak to them as the police were involved.
I just dont know what to do. I got my solicitor in a few hours and also waiting to hear back from the ex landlords to notify me if they tenants have had all their stuff back.
The landlords told me the tenants had something through the post and when they asked what it was, the tenants didn't reply.
Now its just a waiting game. If the tenants agree that everything is back with them then they're calling off the police and leaving it there.0
