All true except the part in bold. In fact a weekly periodic tenancy would arise as the tenancy period is carried over from the previous tenancy. (See S5 of the 1988 housing act )
Thanks N79 - you're right. A typo! So used to talking about monthly periodics. But I did say "should give 4 weeks notice" rather than a month because it's a weekly periodic! :T0 -
Write to the letting agents/ landlord via recorded delivery. Quote some of the following
"The tenant has the right to quiet enjoyment of the property for the duration of the tenancy along with the legal right to live in property as if it was their own home. This means that they have the right to a peaceful existence without undue disturbance. Harassment is a criminal offence under the Protection from Eviction Act 1977 and may result in the landlord being fined, or even imprisoned in extreme cases. Harassment can take the form of:- Entering the property without permission.
- Changing the locks without giving the tenant warning or new keys.
- Cutting off utilities such as gas water and electricity.
- Tampering with mail or possessions.
- Verbal or physical abuse or threats.
- Enter the tenant's home whilst the they are out."

Worth noting that if the T has been required to pay rent on a weekly basis then the LL has committed a criminal offence if he has not provided the T with a Rent Book. LL & T Act 1985, s.4

when i entered the flat to see a new contract, my blood was boiling!
NO THEY HAVENT LEFT ADRESSES ON THE CONTRACTS, and all numbers have been changed!!
they did ask for weekly rent.. and no, no rent book at all!
the new tenants are council benifits and both male so im a bit weary of knocking now i know they could be there.
i did leave a note saying:
i am the tenant who currently has access to this property as i hold
a valid contract with LL untill the 1st march 2010
the date you signed agreements was 27th february 2010.
could you contact LL and discuss the situation.

i left it there, called the police its logged... however the couldnt do anything.
i will contact:
my solicitor, my council and see where we go!
i have a 3 month old daughter and that money would help pay for her nursery/bedroom to be completed!

Somehow you need an address for him. Google his name. Search electoral register locally (is he local?), meet him next friday when he comes for the rent....?0 -
I paid through a bank transfer to his wifes bank account. They dont live local.
they live in a different county as i am aware ( well over 30 miles )
all i know is the area they live as i met them at a bar to pay the deposit etc...
he demanded payment that way as he refused to travel.
my contract would be up by next friday, therfore wouldn't owe him any rent, so he wouldn't be expecting it, and as i said, he dosen't travel to collect rent, he gives bank details so i could transfer money.0 -
SOOOoooo.... you've no address....he lives "in a different county"..... no phone number....and all you have is a bank account number that isn't even his....

Only options I can see are the new tenants (who probobly also only have a bank account) or the land registry records (which I suspect will show his address as... the flat you rent?)0 -

its a new-build apartment in the centre of cardiff!
30 miles from me!
so i can go there but i know its one of those places with underground car parks and an entrance way as hard to get into as fortknox!
plus im only 18, they are at least early 30s
so, you never know. ( if he can rob people blind , who knows... )
i am deffo seeing a solicitor as i will not let this go, i know for a fact i have every right to see this through till the end.
just dont even know how to go!

i can bet my life that the mortgage on the flat is not a buy to let
or that he/she even has permission to rent it out, i bet the mortgage company belive she/he still lives there!
total con artists.
very hard to belive as they both seemed so reliable and the type to have a easy time being in a LL & T relationship.
both work and both dress smartly, both clearly have a fair salary!

You have 3 options now:
1) Check his name /address in directory enquiries and see if he has a landline. then phone him.
2) Write recorded delivery requesting your deposit. At this stage do NOT include threats or criticisms, just politely confirm you've moved out, you note new tenants have moved in so assume the LL has no problems with the condition, and can the LL therefore please return your deposit (£X) without delay /by cheque by return of post? or by transfer into your bank; details...?
If he doesn't answer, or refuses, THEN is the time to start mentioning the things Firefox lists above.
3) Go round to see him (but NOT alone) and ask for your deposit

as soon as i wake up in the morning im gonna post a letter, i have to go post office to tax the car anyhow so i can send a recorded letter from there.
ill just explain as you said,
that i have moved out and as im aware new tennants are in, so therefore he must be happy with the condition i left the place in and so would appreciate an immediate response with a returned deposit.
leave it 3 days MAXIMUM , in the mean time, try calling any numbers i can get and also briefing with a solicitor, and on day 4, go to the property and then once again request the money, if no luck... court
this sound a fair plan?0
