can a debt be enforced?

Hi, i hope someone can help me. When i was younger i was very silly with the debt that was offered to me and got myself in too financal trouble. I got a job as a rep and moved abroad when i came home i pushed my debt to the back of my mind and someone informed me that after 6 year it is wiped from your credit file.

Om now an adult and am trying to get my life back on track. te bank i owed the money too never took me to court even tho i owed 9000 the 6 years are up in august and i was wondering if they will sell my debt to another company who will then take me to court or will they now take me to court? can they do this after 6 year??? and will that then appear on my credit file as a new debt?

please help xx

    if you have had no contact with them for 6 years and have paid them no money for 6 years the debt is unenforceable

  • i know what people are saying about paying it back and if thats my option instead of going to court thats what i will have to do. i was 18 when i got my loan..... can anyone ac tually answer the question about selling the debt on and it going back on my credit file?

    Read here for info about statute barred debts - http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=25_liability_for_debts_and_the_limitation_act (this factsheet relates to england & wales only)
    but they could still take you to court before August, they could sell on the debt and the DCA could then take you to court before the 6years are up.

    If its less than 6 years ago, and they catch you, you have to pay.

    Yes

    If they don't acknowledge the debt for over 6years or make a payment then providing no CCJ its statute barrred. If the creditor or a DCA ask for the money after this point the debtor would just need to write to say they know the debt is statute barred and do not intend to pay.

  • But what happens if they have tried to make contact, as they have phoned my parents home...... if they did sell the debt would the 6 year thing start all over again?

    Its you who has to make contact/acknowledge the debt for the 6year clock to reset.
    No selling the debt does not restart the time span. It still runs from when you last wrote to them or paid them.
