Is anyone here now I can ask for help?

Ok, thanks: I'm claiming JSA and fell ill last Thursday and basically after a very nasty phone call with the job centre today they're closing my case........

Detiails: I saw GP on Thursday (my sign in day was on Friday), called JC to let them know, was told I need to get a form from GP, made several calls to GP, they refused to do the form (less then 7 days), told me I'd need to get JC to request it in writting. JC lady was supposed to call me on Friday afternoon to check with me whether I've managed to get the GP do the form. She didn't call.......
I went to see GP again today because I run out of tablets and am still sick but he can see me only tomorrow morning. So I called JC again today to let them know that I'll be posting (and wanted to also fax in) the doc's form tomorrow and the lady basically said that if I'm well enough to see a doctor tomorrow, I should be well enough to come to the JC and bring in the form myself. I was completely shocked by this statement...........Then the person that I originally spoke to on Thursday (and who didn't call me on Friday) took the phone and said the conversation will end now and that they're closing my case.

I haven't cried in many years but I think combination of the tablets and the sheer rudeness just pushed me over the edge and now I can't stop.........

What are the rules????? Can you please help and advise me?

    Ok rules for sickness whilst claiming JSA, you are allowerd 2 periods of sickness within a 12 mnth period, each period has a maximum of 14 days, provided you are not within (I think on the next bit) 12 weeks of a claim to ESA.
    so basically if you have already declared 2 periods of sickness or been ill longer than 14 days, yes they will close your claim.
    Without your exact details I can't say much more.

    So this is your first period of sickness, how long have you been claiming? were you working or on another benefit prior to you claim?

    Its irrelevant about what benefits may have been claimed previously.

    As mentioned, you are allowed two periods of sick, or 14 days, if either is exceeded then the claim will be closed. The part I dont understand is why they are asking for a sickline for JSA - I've not heard of that being required before - periods of sickness are generally accepted (Although usually a DWP form has to be completed) at face value.

    So this is your first period of sickness and has so far lasted 6 days? No they can't close your claim. Certainly the people in the job centre can't.

    They are well within their rights to ask you for a medical certificate should they have reason to doubt what you say, however, I would expect the case to be referred for a capability decision and for that decision maker to request the cert not a receptionist/FJR in the job centre.

    Basically the GP on Thursday said that for the first 7 days I only need self certification, the JS won't accept that and when I called them today to say that I'm going to see the GP tomorrow morning as I'm still ill and I've run out of tablets (and explain to him the difficulties I'm having with JC) and will ask him for the form again + then post & fax it to them, the lady basically asked how I can be well enough to actually go and see a GP?!? And then said that if I'm well enough to go to see the GP I should be well enough to go and sign in JC + bring the form personally!

    I was completely shocked by that statement.........and when I tried to explain and ask why she's said that, she wouldn't let me, I could barely breathe because I was so sick, saying that made no difference and she just wouldn't let me speak.....and then basically I just started to cry, she passed the phone to the person I spoke to last week who said that she's not eve going to have a conversation with me and put the phone down with her last words: we're closing your case.......

    Saying that I'm shocked and utterly confused doesn't cover that!

    I am on Nat Insurance Cont after my JSA ran out. I am still signing.

    I had a chest infection brought about by a virus, I was literally in bed with it.

    I phoned up that morning and said I couldnt come in, they said dont worry we will send you a form (which they did) and told me to bring it in when I next signed. That was it really.

    I think you need to speak to someone higher up in the JC, you shouldnt have been treated like that
