    Thank you x - I literally couldn't stop crying.....I felt like a dirt on the floor and couldn't understand what warranted such treatment.....I stupidly tried to really be honest and explain everything and this is what I got....
    Thank you again. Hopefully someone can now explain, or give some tips, on what actually job centre's rules are so that I can discuss this with someone when I feel better.......

    They are well within their rights to ask you for a medical certificate should they have reason to doubt what you say, however, I would expect the case to be referred for a capability decision and for that decision maker to request the cert not a receptionist/FJR in the job centre.

    doctors are not very happy to give sickness certificates before 7 days, the law says that we can self certificate for 7 days, I don't see why it should be any different just because you are unfortunate not to have a job.

    If I fell ill on my sign on day and couldn't attend say I had a sickness bug or something and I was told that on the phone I would purposefully make my way there and vomit all over them, and hope that some of them catch it so they have to be off sick too! (sorry! :p)

    I think you have been treated unfairly based on what you have said, and a receptionist has no authority to close claims etc nor provide the information that this is what has happened.

    Make a complaint and appeal.

    I'll pick myself up (when I stop having this stupid crying mood.....) and then speak to someone about this. I'll see doc tomorrow and explain him what happened - if I was well enough I'd just go to the job centre and speak to them but that will have to wait.     Sorry, missed an important bit:

    'medical certificate/SC1'

    I agree with you, but if a formal decision is required, it probably won't be made by a JSA DM so the self cert would probably be required.

    I agree as has been said under your circumstances they should have sent you a JSA28 to fill in. For them to treat you the way they have is shocking and i would put in a very strongly worded letter of complaint naming the people who treated you this way.
  • Make a formal complaint , JCP failed to pay me even though the wife had phoned and told them I wouldn't be able to sign on as I'd been admitted to hospital with abdominal pains . I was discharged 3 days later still very poorly only to be told that we should have phoned them back with details of my illness. The fact that I'd been hospitalised wasn't enough for them apparently.

    There are a limited number of reasons why we would close a claim without referral to a decision maker.

    1, If you have failed to attend a scheduled meeting (of any type) and do not come in or notify within 5 working days. Your claim would be closed at the close of business on the 5th day or on the 6th.

    2, If you have been sick for more than 14 consecutive days. You do not need a medical certificate, even for periods of 14 days, although you may be asked for one if there is a doubt that you are telling the truth.

    3, If you have more than 2 periods of sickness of up to 14 days in any rolling year. These periods cannot be continuous, there must be a break between them.

    4, If you have a domestic emergency which prevents you from attending or meeting your JSAG for more than one week. Definition of a domestic emergency is at the discretion of the advisor/assistant advisor.

    5, If you have more than 4 incidents of domestic emergency in a rolling year. There must be a break between each period of domestic emergency.

    6, You request the claim be closed.

    7, You leave the country unless you are going abroad for an interview, have proof of that interview and have notified us in advance.

    Do any of these apply to you? If you are frequently calling in late/sick/domestic emergency then the JC will ask for medical certificates, but should normally refer to a Decision Maker if there are doubts, before closing the claim. However, if you didn't make any contact for 5 days then they're within the rules closing your claim. You can reclaim, though.

    hi im just looking for advice?

    hi last year i had a few problems with the jobcentre, concerning 2 complaints i made that never did get followed up, when they was addressed i had a big meeting and at the end of the meeting i was asked what i wanted from there error, i asked for them to pay £150 for an eyebrow threading course, which they agreed to pay,also as im homeless and only have a care of address, jobcentre agreed that all appointment in the future would be by phone or email, any way december 09 i went to sign on as normal and was hand giving an app for jan 14th 2010 and to sign on to, i did attend this, and was also informed that i had a next appointment on 25th feb 2010 with my advisor, anyway my last payment of JSA was on the 2nd febuary,my next signing day was the 11th febuary which i signed as normal,and exspected my allowance on 16 febuary which did not recieve, so i called the jobcentre on the 17 march to find out whats the situation, i was told by romford job centre that they did not no anything so i rang ilford main head office, and to my surprize i was told that i had missed to appointments that was apparently sent to my care of address, i told them i did not recieve any letter comfirming this, and my claim was suspended untill i had this meeting ? on that wednesday i had to ask for a crisis loan as im homeless and need to pay for shelter or to stay a friends hse so i can have a cooked meals gas and eletric is not free. they no my situation and that i had to be informed of any appointment via telephone or email. also i recieved a phone call later that day from a man saying to me that i did recieve these letters and i had to wait a whole week till this lady came back from holiday to recieve my payments, on tueday 23th feb i recieved a call from a lady saying i had to come in for that appointment on 25th febuary at 11.00am i di explain to her that i had appointment at 2.30 with my advisor also to sign on again and that i did not have bus fair to go back to the jobcentre as i have not been payed still, she was very rude and said if i did not attend both appointment she will close my claim, any way i did attend my 11am app when i got to the jobcentre i went to reception and the did not no of any app for 11am? so they sent me upstairs to find out if it was there, they too did not no of appointment, only my 230pm app, so i then went downstairs with an advisor she was helping me, when i got there this lady approached me and was very rude to me saying that i was late, when i was not, so 2 of the other staff told her that i had been in the building at 11.am by this time it was 11.30am she looked very upset. i then asked her why my name was not at reception, she replied i thought i catch you at the door, she didnt even no me any i then went in to an office with her to chat about my claim, by this point i was quite upset all i was thinking im starving, i had 2 bank charges, catalogue charge also, i was very fruststrated to why i was not informed by phone as agreed 2009 and the damage this has now caused me, get back to the point, she aked me for id which i showed her, then when on to address, i told her that this was a c/o address and that i do not always recieve my mail on time if im not informed that there was a letter to start with hows im ment to recieve it and that i do not have a key to this property, that im homeless and basically sofa surf around friends, she then said to me thats your address i said no thats my care of, she said no thats your address i said no that is not,im homeless, she then said to me i can not be homeless for more than 2yrs,i was upset,hungary and frustrated not angry so after ignorance towards me, i told her that i did not want to carry on this arguement and that i wanted a witness in the room as she is being very ignorant to the facts so i stepped out the room and asked for some assistance everybody in the jc was just standing ignoring me, so i may have raised my voice saying abit out of frustration saying how dare you tell me that im not homeless when i am, i di find thids very offencive and was very very upset, i did go out of charactor for about a min just because every1 was ignoring me, then i had a few security come up to me i told them its not me its what she said to me that i can not stomach i said you dont have to worry about be im not a nutter just homeless starving and not been payed for weeks now, i have also lost a stone in weight in 2weeks i am 7stone now and 35years old, i then went to the phones to complain to ilford as to the way i was treated and that i was intitled to some one to assist me thats what they say said, then i was put on hold, in that time i was approached by a security and he came to my face and was very horrible he said that if i start hes going to grab me and sling me out. i told him to step away and not start an arguement with me as i was calm at this stage, so he just walked away, after my phone call i then left the building, and later recieved a phone call to tell me that i was not allowed to go to the next app at 230pm, i then recieved a letter at the weekend saying im a potential threat to staff and that the poolice will be called next time and other orgornisations have been informed i have just registerd with the coucil to be re-homed as i need stability in my life but now this woman has stigmatized me for something i have not done and because i re-acted to her 3 comment staying i was not homeless and that i cant be homeless for more than 2yrs, what a load of rubbush how dare she, i am at my lowest ever now and my weight is shocking, can i sue for personall injury for her comments that she has made to me, and the fact that she caused my change in charactor as i have never acted this way before towards any staff any where, i am very polite person, and have very little heart left after this scene that was brought to me. can any body help or advise me as tomrrow i have the second re-arranged app at 930am, if im such a threat to them why are they letting me back in the building, ?
