hmmm... i might "offer" to leave 3 days late even though the S21 is now invalid and pay the 3 days rent, perhaps a week...
And tell them I'll forget the fact they didn't lodge the deposit in a protected scheme is illegal, so I only owe the extra time0 -
Well I spoke to LL company about the "rent/Bond" situation and to say they weren't happy was an understatement... I've sorted the house move so that I'm out on the correct day so no need to be out late. so now as far as I'm aware I dont' owe them a bean.... so now they've said I can only use my "rent" as rent if the house is to their standard.... and judging from the attitude I had on the phone I think they will be extremely picky....0

More fool them for trying to be clever. Rent is rent not a deposit - stick to your guns.0

I do intend too, if they do become "funny" and try to pick holes so to speak in the condition of the house (it was a brand new build and i was first in so it'll never be the same condition as when I moved in.) they'll have to bill me for any repairs? and with no signed inventory...0

Well they may be picky but if they want you to pay for anything they'll have to take you to court (unless you cough up voluntarily). If they are just trying it on they are very unlikely to bother. Be firm with them - just remember most letting agents and amateur (ie 1-2 property) landlords have very little legal knowledge and make things up on the spot if they think it will make them a bit of wonga.0

There little to do really, the back garden is not as "green" as I weeded it, with all intentions of planting grass, there was a lot of weeds.. and since then it's snowed and the weathers not right for a nice growth.... so my nice intended lawn is now never to be.. the cream carpets have been washed, I'm going to give the walls a good clean/wipe over (there was a few scuffs when we moved in)0

Sounds like they won't have a leg to stand on then. I can hardly imagine them going to court and suing you for digging up and destroying their weeds!0 -

Whilst I don't condone LAs/LLs who fail to comply on tenancy deposit regs, you also need to bear in mind that once you overstay your Fixed Term expiry date, the tenancy becomes what is known as a Statutory Periodic agreement which runs from month to month (assuming rent paid monthly, ) with the LL having to give you 2 months notice and you needing to give one month, to tie in with the rental period.
Just as your LL can't have it both ways, neither can you. Either you argue that the upfront payment was rent, hence you are not paying your final month's rent or you argue that it it was in fact a deposit and therefore an S21 cannot be validly served.
You've already commented on the fact that you have had rent arrears at some point, so it sounds as though you haven't kept to your own obligations under the tenancy agreement. The fact that it was a "brand new build" means that its more likely they can provide sufficient evidence of the condition of the property. As a T you are obliged to return the property in the same condition as when let, save for "fair wear and tear".
