yikes.... did the rent to ghosts? that must be a nitemare to keep clean. we should start a thread to make LL to carpet houses in brown or black. lol.0

He sold the house for 166k to a first time landlord, who then rented it (with it's white carpets) to a single mother and her two children, on benefits.
LL now lost his job. Houses like that now selling for 136k. Rents dropped from 700pm to 600pm. Single mother caught out as didn't declare her boyfriend lived there fulltime, but I don't know who is the one who has to pay back the housing money (landlord or "single" mother). I am moving out so yeah not a big problem, though I was thinking more along the lines of the reference of them for not paying the last month, i had arrears which i caught up on so just felt a tinge of guilt...0

Right got through to someone with sense... the LL has not paid my deposit into any of the protected schemes, I hav eno signed inventory and he's served me a section 21 notice to leave which I will be doing, as I've sorted my next property out, which unfortunately is 3 days after this tenency was due to expire..
So:
1. I know i can tell them to use my "deposit" as rent....
2. if they try to be funny with me over this and want to deduct for "damages" on normal wear and tear, where do I stand?
3. Am I right thinking the section 21 is not void (even though i signed the notice without realising i had an unprotected deposit?)0 -

Seems to me you have two options:
1. Your 'deposit' was actually rent in advance so can be used instead of paying the last two months (tho you only have one left). In which case you need to vacate on time or another full month of rent will be owed and you will lose the remainder of your 'deposit'.
2. You point out that your 'deposit' is legally a deposit and should have been lodged in one of the three schemes. You ask for this to be lodged immediately pointing out the three times penalty. In this scenario your S21 is void as the deposit was not lodged at the time, so you can move out three days late tho you then ought to serve one months notice yourself.
If your deposit is lodged and unfair deductions are made you use the arbitration; if your 'deposit' remains as rent in advance you may have to use the small claims court.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0
