Checking my bond

Just going through my papers... and couldn't find paperwork on the bond... then I couldn't remember receiving anything... then I checked my tenancy agreement, and noticed the LL's letting Agency I found the property with had written on it..

"no deposit but 2 months rent, will give back if house and move is ok"....

now I moved in a hurry, and to be honest I hadn't thought of it until now but isn't this illegal?

    This would be treated as a deposit and should be protected (assuming you had an AST).
  • Had a 6 month ast which has expired and due to leave in a 3 weeks time.

    I've looked and I can't see any proof that it's been protected?
  • Just concerned now if there is issues on getting it back?

    Write to the LL requesting that the deposit is protected. Do it now before the end of the tenancy. Remind the LL and the agent that if they do not protect your deposit then you can ask a court to order its protection and a payment of 3x the deposit. Should make them see sense.
  • If I havne't had it protected, could I basically say to them that in lieu of protected deposit, consider that as my last months rent?

    sorry i'm leaving 5 weeks not 3?! so last rent is due next week...

    Yes, as they have stated that it is rent and not a deposit

  • Just got home and on the tenancy agreement it say deposit to be paid into whatever scheme the LL decides but handwritten onto the agreement is "No deposit 2 months rent paid2 also there is no inventory (assuming this is because the house was empty and only thing in there was carpets..

    so..
    1. I can tell them to use the "2 months" rent I've paid as payment of my last month, in lieu of deposit, and
    2. I can just hand over keys with final meter readings and go, as I have no inventory to sign off? obv once they've had a look around make sure all if fine?

    Is this right?

    Yes you can do this - after all it is rent and not a deposit by their own admission. Presumably if you have paid 2 months rent up front then there will still be 1 months overpaid rent to come back?

    Also since it is rent they can not use this money for any damage you cause.
