  • Do not threaten to withdraw your offer unless you really are prepared to do so.

    If you make a threat that you do not carry out the estate agent and vendor will see you as a weak negotiater who will back down. Depending on what your survey and searches turn up there may be further negotiating to be done.

    I'm going to have a look-see tomorrow. Another condition was that the sold board goes up within a certain time.

    I may view another place down the same road if I can. Then I'll pop into the EA's office in person and express my views!

  • Lots of agents have rightmove automatic updates, which is midnight every night. However-it is possible to manually remove it within about 30 seconds! I have to say though, I probably wouldn't do it on your say-so, I would take instruction from the vendor and if they want it leaving up, then that's what would happen. I would explain that to you though! Have you got the ball rolling with survey and solicitors? Vendors might be reluctant to remove property from the market if you've not got those bits sorted yet.

    I would go further than princessamy - the EA has an obligation to leave it on the market till the vendor instructs otherwise. The EA is employed (and paid) by the vendor, not you, so can only take instructions from the vendor.

    EA should pass on to the vendor your conditions - but it's for the vendor to respond, not the agent.

    Of course, if the vendor does not comply with your conditions by telling the EA to keep marketing, then it's up to you to decide whether to withdraw your offer.

    if your offer was made quite clear - which it was for the agents to be fobbing you off - and accepted, then they are not doing their part.

    in other words, another buyer could come along more readily now than if the property wa sno longer advertised.

    you could be wasting your survey/legal fees etc.

    some agents are like this, is it a national/chain one by chance?

    you could give them an ultimatum if you intend to follow through, and say unless both adevrts (rightmove and wensite) are removed by 5pm Friday, your offer is withdrawn - and mention another property you are interested with a local independent estate agent / competitor, that is a good ploy as they will want to keep your offer

  • Once we put our offer in the EA asked their in house mortgage advisor to just go through figures and details just to make sure we we'd be able to get a mortgage as we are FTBers and hadn't pre-arranged our mortgage. Once that was done the offer was put to sellers, eventually agreed and then as part of the offer and agreement the house was officially 'sstc' on both rightmove and EAs site the next day (our offer was accepted at the end of their working day) and EA agreed not to show anyone else the property.

    I cannot see any fair and legitimate reason for the property to still appear available for sale on the Internet sites if the agent said they would remove it.
  • After our offer was accepted, the listing was changed to under offer on the website and rightmove pretty much straight away.

    But it seems like quite a few listings are just left up as active and still for sale to attract interest - I've rung up and enquired about loads that don't have 'under offer' on them just to be told 'oh, no, that one's sold'.

    The good thing at least is that the estate agents don't then allow any more viewings - the ones that i've come across seem to have turned against gazumping in the past year or so.
  • I know how you feel it's so frustrating, but imagine how I felt when I walked past an EA and saw the house I'd moved into 2 months previously for sale in their window! Sometimes they leave properties on the market to attract interest and start a dialogue with buyers, but if you've started moving on the purchase you could suggest the EA might be reported for false advertising :eek:

    Personally I would ring the agent and double check - ask them straight out if there has just been a delay or if the vendors have asked them to keep it on the market. If they say it's just a delay, then I would ask them for a firm date/time that it will show as sold. Get them to commit to it.

    I wouldn't withdraw the offer, but I would remind them that the offer was made with the condition of it coming off the market and say you are going to ask your solicitor to do hold off doing anyhing more until that bit's sorted, and not instruct the survey until you are confident that the deal is as agreed.

    I think this advise is spot on.

    If the owner has accepted your offer with all its conditions then insist the EA gets a letter to you pronto confirming that. Then you can insist the EA does their bit or not depending on how you feel.

    If you really don't like the EA then arrange a 2nd viewing and talk to the vendors direct and ask how they feel.
