EA wont let buyer have the HIP

  • The EA does not have to send you a copy of the HIP. The EA can send you an electronic copy if they wish to but there is no legal right for you to see the HIP unless you are in the process of buying the property.

    You can request a hard copy of the HIP, however, the EA has the right to charge reasonable coping and postage costs.

    I know this is pedantic but the title of this thread is a little misleading......you aren't the buyer of the property yet.

    No need to tell the seller, the EA has done nothing wrong.
    They are not doing it right, either. As seller, I would be interested, very interested to know if EA was not providing the HIP. Probably the best way would be after a viewing, when EA gives feedback to the seller, to establish whether seller would entertain an offer from the viewer, in which case the HIP _should_ be made available.

  • I agree it's not ideal to view at HIP in the EA's office but tbh surely you can't be that keen on a lot of properties? I would probably hone it down to 2 or so (there really isn't that much decent stock on the market around here at least!), and then it's not so bad.

    Do appreciate what you are saying though and it's a question I asked my EA when putting my property up for sale. In the next breath though I did say to her that I would want to know a potential buyer is 100% interested before giving them the HIP. I can't see why anyone would want to read it unless they are about to put an offer in and are firm on proceeding unless they see something alarming in the HIP...
  • The HIP should be avaliable to view. Really if the agent had something about them they would have the HIP electronically stored or could point you to an electronic source from where it was produced

    I didn't say that I agree with what this EA was doing, I was just pointing out that legally they aren't breaking any regulations.

    Would I email a copy of the HIP to someone who asked.......probably
    Would I copy and post a copy of the HIP to someone who hadn't even viewed the property........probably not (in my mind the aren't a serious 'buyer' until they have actually viewed the property)

With 20 years experience of Sales/Lettings and having bought and sold many of my own properties I've usually got something to say ;)

    Wow! I seem to have opened a can of worms here!

    I seriously do not understand why it is a problem to email a PDF of the HIP to a potential buyer on request?

    Why am I asking for a PDF of the HIP before I view the property?

    1. I'm looking for specific geographic/location details and to find these I'm having to cast my net over a fairly large area (2 counties) - I'm lucky in that I'm free to search in a region and am not tied to one particular location. The HIP gives information I need that is often not in the agent details. It helps me decide if a viewing is worthwhile in an area with a lot of property available. This saves everyone's time!

    2. I'm a chain-free cash buyer and want to move fast when I find the right property, requesting and being provided with a soft copy of the HIP at an early stage is helping me sort out the serious sellers (and the agents who are more likely to help rather than hinder the process).

    3. I'm looking for a property I can possibly develop/extend at a later date, the HIP gives important informaion on the placement of sewers/mains water supplies so helps inform my view of the property's potential.

    And finally, I'm the one spending the money so it is my way or not at all!

    Do you provide photos of properties you are marketing? Room dimensions? Details of heating systems, parking, outside space? How is the HIP any different?

  • Only the seller can refuse to show you the HIP and only in a very few specific circumstances (as I detailed above). Contrary to advice given here - the responsible person (in this case the EA) has a LAWFUL duty to allow access to the HIP under section 156(8) of the Housing Act 2004.

    They have 14 days to comply - then I suggest you go to Trading Standards.
